Standard approach these days from Excel.
Time for a strident complaint to the BPA asking them to take action against Excel for failing to provide a POPLA code, when their recent missive to PPCs made it clear that motorists should not have to 'beg' for a POPLA code. Ask them how many Sanction Points will they be applying to Excel for not complying to their CoP. Copy all your correspondence from Excel to the BPA with your complaint.
Make Excel very clear that you have complained to the BPA (copy them your letter to BPA) - tell them they must provide you with POPLA code.
When you get a mealy-mouthed BPA response, basically proposing to do nothing, complain about them to the DVLA and ask why they are still recognising them as an ATA.
When you get a mealy-mouthed DVLA response, make a very serious complaint to your MP.
I know this sounds quite convoluted, but unless those directly involved in this process (i.e. you and other similarly pursued motorists) take such escalation of complaint, then we're never going to be doing anything other than firefighting individual fire outbreaks.Please note, we are not a legal advice forum. I should clarify here, that I HAVE previously received a POPLA code and submitted the appeal.
This new notice is a 'Liability Notice', and makes no reference to the POPLA appeal.
This new notice stipulates that it has been issued for 3 reasons of failing to respond to the original PCN, which is blatantly not true.
I wanted to highlight the fact to them that not only have they ignored my request for any further communications not related to the POPLA appeal, which clearly this new charge notification is not, but that the notice has been issued with no reference to a pending appeal and therefore presumably breaks some code of practice (if it's appropriate)0 -

If there is anything in the process that is not in line with the BPA CoP, it warrants a full and strident complaint to the BPA.

I expect, and will accept without repercussion, an appropriate apology and explanation from you within 14 days of issue of this letter.

I had another thing I was going to raise in the letter, but thought better of it, so as not to give them any ammo in their favour during the POPLA appeal. (I will save that for post-appeal!)

Hi,
Is there any update from this case? I've just received a parking ticket from the same place and wondering if it's worth an appeal. Annoyingly I was told this was free as I was a customer of a shop. What I wasn't told is its only free for 10 minutes. None of these shops at the Walk will get my money anymore.

At the moment there is no update.
The POPLA appeal has been submitted, and there has been no further communication in regards to the case since submission.

Please read that thread of FAQs for newbies and appeal. We have 100% record of winning appeals at POPLA stage, for over a year now. This is NOT a fine so take the advice we know works. There is no fine so no increase. You'll win at POPLA if you use our templates - so of course you must appeal.

In the last few days I have received the evidence pack from POPLA / Excel.
I immediately jumped in to take a look at the pictorial evidence which is far from compelling!
Firstly, the images submitted are NOT up-to-date. They do not show the entrance that was used to be accessed from a roundabout, which means they are using stock photographs taken from BEFORE the site was altered.
Secondly the images were taken during the day, when the incident occurred during the evening and does not highlight how poorly lit the relevant signage would be!
Unsurprisingly, they've included a redacted contract in the evidence pack!
Happy to attach the appropriate image here, if it's appropriate.
Do I update my appeal to highlight these points to the adjudicator?0
