Oh I did raise the issue of others using their card in my appeal letter....

I don't think I was in any state to defend myself at the meetings as I was just so distraught that everything had got to that point...it was all so surreal tbh
Regarding your ex employer and your appeal You're at a point where there's not much more to lose and possibly plenty to gain.

Tell them you wasn't prepared in in a fit state to explain your actions. Point out it's custom and practice for others to do the same, therefore you believe the punishment to be disproportionate.
  • I don't actually get to meet anyone face to face re the appeal. I had to send in a letter fao head of HR.

That seems odd, nay wrong. Do you mean you had to send a letter to advise of intent to appeal and arrange an appeal meeting/hearing?
  • No my actual appeal had to be in writing only...I don't get to attend any meeting face to face.

It seems a strange way of doing it, as it is usual for the Appeal to be the same set up as the original Hearing, almost like a re-hearing and preferably with a different panel. Whilst I don't expect you to name the Company concerned are they well known or are they just a small outfit?
  • They are well known.

    Hello Shazza,

I've not read through the entire thread but just wanted to say I hope you get back on your feet soon. In my opinion people do make mistakes and deserve second chances - I'm not sure about third or fourth chances but I think we should all be allowed one error. So I hope things start to pick up for you soon.
  • Thank you Loco....yes another chance is all I want...I know I messed up everything but just want to work....

Thats why its important to get advice, from a union or an employment lawyer, because sometimes what employers tell you what you have to do, really isnt good practice at all.

The fact that theyve given you your p45 before theyve made a decision re the appeal isnt good.

You should get some advice about whether this appeal is being conducted appropriately

It should be with a different panel and people who havent taken part in any of the issues to date, for reasons of fairness and impartiality

That isnt what always happens in practice though
