Finding a job following dismissal for gross misconduct

Thank you Walcott...
I've been honest in my interviews this week so just have to keep everything crossed I guess0 -
Don't forget to mention that you have lodged an appeal. As of right now, your GM is actually subject to review. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Got my hopes up about interview today as they asked if I would be available for follow up interview tomorrow and would call tonight if I was shortlisted....no phone call :-(((
Note to self...do not get hopes up!!!0 -
As an employer I have had to fire one person for GM , We employ a company to deal with employment issues , and I had to follow their proceedures to the letter and involved the employee suspended on full pay an investigation meeting with his manager, then a meeting with the employee ( with the right to representation ) , this all took nearly 2 weeks . I was leaning towards a final written warning as the employee had been with us a long time , but was advised that if we didnt dismiss we could leave ourselves open to problems in the future , as it invoved drink . The employee was then told he had the right to appeal
So I dont believe it is easy to dismiss someone .
Even if we need to give someone a warning its a bit of a performance
From the OPs posts I would think they were employed by a large company ? , and as such they dont have a lot of leaway and have to be seen to follow proceedures/ rules to the letter
My employers by their own admission knew nothing about employment law and I mean nothing. They just did as they pleased and made me ill in the process.
It was very easy to dismiss me. They suspended me when I was off ill with work related stress due to my awful working conditions, disciplined me for going into grievance and then sacked me
I called ACAS on one occasion who told me any employer can rip up a contract and its up to you to prove they shouldnt have
If someone has less than the two years service that would entitle them to go to tribunal, its very easy to sack someone
Also, there are so many companies who dont follow any kind of procedure. Your company sounds like they follow what they need to follow to the letter.
Ive worked for companies who dont even follow their own procedures and who dont know anything about employment law, cant even understand their own policies and procedures and still think its ok just to sack someone on a whim
So many people get dismissed and companies dont follow proper procedure, the number of employment tribunals would bear that out and thats only the cases that actually go to tribunal
And I bet there are many many more employees who dont get dismissed but whose working conditions are awful and end up on warnings they dont deserve
Ive had to discipline people in the past as well, but it was always as a last resort and peoples were treated fairly, allowed representation, procedures followed to the letter and allowed to appeal. Thats the way it should be, many employers just dont care.0 -

I know it is difficult right now but try to stay positive. There might be something even better around the cornerThis is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Hi Shazza,
Now firstly lets keep this situation in perspective....you have "made a mess of your life", .....this is a temporary set back.
Keep your thoughts positive, you know that you are a good worker and a good person....you are proving the latter by beating yourself up about this.
It would be easy (and maybe) successful not to mention the GM factor at interview but I feel if it did work and you got the job you would (rightly) beat yourself up once you begin working by saying "should I tell them".
If you did that then the new employer could take the fact that you didn't tell them at the outset (and then) you telling them what the GM was for could paint a completely misleading picture of you and then decide maybe they can't trust you.
For your own sake be truthfull...they will realise that being open would be no easy task for you at interview.
Then as others here have said promote yourself.... with the fact that you don't flit jobs, you work hard and get promotion....and see if you can get a reference from your first employer too.
Also don't forget to press the point of what you can bring to the post you are applying for....let them see that you have thought hard about how you could fit in at the new place, and the new job.....it should come across that you are not panicked into applying for another job.... infact their post looks a logical step....turn the situation into your favor...and hopefully the new employers too.
I think that if your reference from your last employer doesn't mention a reason why they let you go it may go a long way if you explained what happened...you could phrase it as " In order for you to have a complete picture of my employment past I should point out that I am looking for a new postion as at the moment my dismissal from my previous employer is under review".
Then if asked to explain lay out the facts calmly.
Looking at things from your previous employers point of view (with the way things are....employers market etc) who knows but perhaps they could see an annual saving by employing someone else on lower pay than you were getting....or not even replacing you....saving a redundancy package.
Thats why it's good that you are getting the outcome reviewed.
Good luck with everything.0
