    What do you all think about the fact though that his MOT had failed an hour previously.....could that be brought up in court even though the letter doesn't mention that?
  • If you fail an MOT you are allowed to take it away for repair so you should be ok on that score. I think the lack of Mot will be the least of his worries!

    It's possible they may bring the mot up, but you are allowed to ride it home after it's failed. Just not in excess of the speed limit.

    He wasn't pulled over and given a producer so I cant see how he would get prosecuted for no MOT.
    There is no where in the system for this to come to light unless he volunteers this information.

    Contact the pre-court office and ask if he can fill in a statement of financial affairs, obviously don't fib its perjury but make sure he lists every outgoing he has on it. The less disposable income he has the better.

    He's probably facing the higher end of 3-6 penalty points. There's also a short term disqualification option of up to 56 days but he would be very unlucky to get this. Whatever he gets make sure he informs his insurance company.

    Unless his statemeant of means makes it clear that there isn't enough money to pay a fine. Then the magistrates might decide to ban him instead.

    Sadly this lad probably won't be able to afford a car for a couple more years now... 18 with 3pp would send any young lads premiums flying through the roof, let alone 6.
    Betting even with a black box he'd be looking at a policy in excess of 2k.

    The fine the courts impose will be child's play compared to his hex insurance policy

    Not true, the Police National Computer holds MOT information.

    Why does it matter, no MOT is an absolute offence. However as he was on his way home he has a defence.
