Yes - send them another email and point out that you have made your appeal sent on xxxx and that their parking charge notice does not fulfill the requirements under POFA 2012 to invoke keeper liabilty and that under their Code of Practice either a keeper or a driver can appeal.
You have nothing further to add to this statement other than they should either cancel the charge or issue a POPLA code - and you will be making a formal complaint to both the BPA and DVLA that you are being deliberately obstructive and that you are in breach of the KADOE agreement with the DVLA.0 -

yes, the above breaches of the CoP and also no popla code given despite having requested one, not following the recent BPA newsletter guidelines, etc
basically everything pointed out already and should have been sent in 10 days ago !

This is what the dvla has issued“the following practices may be considered as Code breaches and must not be continued:
• Asking the motorist to enter into additional correspondence to obtain a POPLA code
• Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
• Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
• Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “

Yes as per previous advice given:
1) The registered keeper made the appeal but ANPR PC are refusing to issue a POPLA code as per the BPA COP (write abbreviations out in full)
2) They are making statements of misrepresentation regarding liability, adherence to COP and the notice is not compliant under POFA to invoke keeper liabilty - thus driver can only be pursued.
3) ANPR PC are falsely declaring that a POPLA code will only be issued if the Registered keeper names the driver and the keeper has no legal obligation to name the driver.
4) In view of the above and ANPR PC's refusual to issue a POPLA code and breaching your COP and the DVLA KADOE contract - I request that you instruct your member to cancel this charge forthwith or issue a POPLA code.0 -

Hi All,
Well, I never heard anything more back from ANPR - not a confirmation to say that they has looked at the complaint and dismissed it, no indication on providing a POPLA code. Foolishly, I did not writ a complain to either the DVLA or POPLA, and I thiought just let bygones be bygones.
However, earlier this week I received a debt collection letter from DRP demanding payment!
I will no, of course, raise a complaint with both of the above, but do they hold any sway in retrieving money this way?

No as debt collectors are completely powerless to enforce payment! I despair at times. Advice was to complain to the BPA and DVLA on 14 February and given by the forum's most senior and experienced regular, Coupon-mad.I would make a complaint NOW to the BPA and DVLA that ANPR Ltd are pretending the new CoP says things it doesn't, and pretending it relates to an old case. Then followed a series of responses to the request for what to include in such complaints and another 3 highly experienced regulars took time to provide further advice. Despite all the input, advice was not followed.
This would have been well and truly put to bed had that advice been taken and acted upon.
There are no 'bygones be bygones' in this game. What's 'gone by' is the chance to have seen this off three months ago, now the only thing to look forward to is grief and hassle from debt collectors for goodness knows how long.
The only saving grace is that debt collectors are powerless - but they are a nuisance that could have been so easily avoided.
Hopefully advice given NOW will be followed!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
