Likely consequences of unpaid ticket

I had a parking ticket from LPS for parking in a pay and display car park and recently lost my appeal with POPLA, the fee is £85 what is likely to happen/outcome if i dont not pay this and ignore any correspondence?? Any advice and experience would be much appreciated

    Can you post copies of your appeal and their evidence and the POPLA rejection, redacting all personal information.

    To answer the specific question ... the POPLA decision is binding only on the PPC and not the motorist - you still don't HAVE to pay it. The PPC would then need to raise small claims action against you (and win the case) to MAKE you pay.

    The reality is that you'd get lots of letters from debt recovery companies (known as threatograms) and then it may just die away. But court action is always a possibility for up to 6 years after the date of the PCN.

    Around £200 but it does vary on a case by case basis. That said, if you take forum advice ( should you get court papers ) then you would most likely win. You clearly made a mistake with your POPLA appeal - they are easy to win so make sure you don' t make a mistake if you get court papers.

    Is it too late to contact the land owner & how would i obtain this information on who is the land owner/contact details

  • No you cant

    Have you actually received a "court letter/court claim/letter before action", or are you just speculating

    If you want to find landowner details i suggest you do a land registry search, it costs around £4.00

    normally you can only appeal once to popla, no second chances for you but if you were not the driver you could name the driver (for a postal pcn , not a windscreen pcn) and then they could deal with it at popla due to the new pcn in their name, using a better appeal than you did

    as for finding landowners, not always easy unless you pay the land registry a fee and find out, so google it , look for previous threads naming the landowner or managing agents, ask any tenants who they pay rent to , etc

    do not expect some easily found list of every landowner for every piece of ground in the country , they like to hide their assets behinds fronts and aliases and managing agents , many are owned by pension companies or financial institutions or big retailers

    easy it isnt , but the more you dig the more you may find out

    Have a look at the sticky by Crabman which has all the permanent info & help links. You'd want to read the small claims part of the NEWBIES thread, and the LBCCC thread, and the Successful Complaints thread (and if this was a retail car park, aim for the Store Managers first).

    Have you actually got Northampton Court papers? If so, acknowledge them and state you will defend in full then let us know where you are with it. You do need to read the small claims links & stickies first though.

    Thanks again for all your help/suggestions

    Cut a long story short i stopped at a Pay & Display car park (waste land) to get my two sons (age 6 & 2yrs) but had no change so parked up & headed for shop to get change to purchase ticket, on my return 6 mins later i returned with change & no ice creams or purchases to find a guy taking a photo of my car & place a notice on my windscreen, i explained my situation & showing him i had no pruchases & pointing out my two young sons thats what took me 6 mins, but he was not interested & ignored me except for saying explain it to them! I took photos of my clock and dashboard for time i returned to car sent to them with also photos of my 2 sons from that day with full explination and they requested that i sent in the ticket that i purchased after i obtained change before they can look into it further, i explained we were all distraught & wasnt advised or think to do this so they said the guy recorded he kindly advised me to purchase a ticket with my change (LIES!!) put my appeal to popla & had this back two months later

    The Operator issued parking charge notice number arising
    out of the presence , , of
    a vehicle with registration mark .
    The Appellant appealed against liability for the parking charge.
    The Assessor considered the evidence of both parties and determined
    that the appeal be refused.
    The Assessor’s reasons are as set out.
    In order to avoid any further action by the operator, payment of the
    £85 parking charge should be made within 14 days.
    Details of how to pay will appear on previous correspondence from the
    operator.
    10 February 2014
    Reasons for the Assessor’s Determination
    It is the Operator’s case that a parking charge notice was correctly issued,
    giving the reason as: ‘Parking without displaying a valid ticket’. The Operator
    submits that a parking charge is now due in accordance with the clearly
    displayed terms of parking.
    The Appellant does not dispute that the terms of parking were clearly
    displayed.
    It is the Appellant’s case that he briefly left the car park in order to obtain
    change, but returned to find the operative had already issued a parking
    charge notice to his vehicle.
    Any requirement that a motorist display a valid pay and display ticket must
    include an implied grace period granted to the motorist in order to obtain the
    ticket. The motorist must obtain a ticket as soon as reasonably possible.
    Although I sympathise, I do not find that leaving a pay and display car park to
    obtain change constitutes paying for parking as soon as reasonable possible.
    By leaving her vehicle unattended, I find that the Appellant was ‘parked’ and
    so parked without displaying a valid ticket.
    I find that, by failing to display a valid ticket, the Appellant became liable for
    a parking charge notice, in accordance with the terms of parking displayed.
    Accordingly, I refuse the appeal.
