Ebay not refunding money for item not received

    you only give the seller the time stated by paypal for it to arrive

    The problem is that it's not obvious to people that their section 75/chargeback rights are waived when they use payapl.

    It's not obvious that paypal is a 3rd party unlike say - world pay or sagepay.
  • Ive had a similar issue in the past but i somehow managed to get the refund in the end. i showed all the emails i was receiving with dates etc so that they could see i wasnt doing this for the sake of it. It went on for weeks maybe you just need to get the right member off the support team who actually wants to help rather than use the simple rule of saying sorry your over the time as its the easiest and quickest way out for them. hope you get it sorted

    So you think people believe that Paypal is part of their credit card company - and not a third party? Not sure i get that one.

    I will say to piggybankrupt, that Ebay/paypal's latest terms did say that they can increase the time allowed - at their discretion.

    As this was custom made etc - you could try get them to allow the case. Not sure how flexible they really are though. I think the rule was just intended to allow them extra time to harrass the good sellers.

    Various correspondence came via email from the supplier apologising for delay in delivery as they were really busy & had taken on more orders than expected and asked me to be patient on delivery (order had said normal delivery within 15 days of payment). I accepted this as I was pleased their business was going well and was happy as long as unit delivered by Xmas.

    Sounds like a con. Those customers that didn't follow the rules lost their money. The Company knew that.

    No, that's not what I'm saying.
    Many times when I pay an on-line retailer I get taken to a service provider (like worldpay or sage pay) who simply process credit card payments for the retailer.

    How does someone know that paypal is different, especially if they use it as a guest and type in their credit card number.

    How do they know that one is simply an enabling serviec and they are paying the retailer and one is actually making a paying to a 3rd party and hence section 75 rights with the retailer are lost.

    Are you saying it's obvious? If so how/where is it obvious to say a newbie?

We were emailing them the buyer(s) were emailing them with both of us becoming increasingly frustrated.

    They are not subject to UK regulation and you are pretty much at their mercy in a dispute. Anyway, as I said lesson learned and I've hardly used them since.

    If it had been a fraudulent use of card claim then you were covered just by proof of posting. If it was a PayPal decision then a quick phone call would have dealt with it as long as you had full seller protection.

    Incidentally, there is nothing at all wrong or dodgy about someone buying an item and someone else paying for it.

    They suspended the money pending an investigation and absolutely nothing seemed to happen. I don't remember phoning them, but I emailed them multiple times using their complaints process as did the buyer. This dragged on for at least ten days until the buyer eventually sent me a cheque. So I never heard how long it took her to get her money back.

    I certainly didn't see anything wrong with one person clicking buy and her sister paying for it. We did everthing we were recommended to do; waited for payment before sending it off, only sending it to a registered address, getting signed for delivery etc. Both the buyer and us had long held accounts with high ratings. The whole experience was difficult to understand, quite bizarre in fact!

    I don't think I'll ever trust them again. All of my transactions since then have been low value items, magnets, helicopter tape etc. Before that I had bought a number of large high value items, including two cars and a nearly new caravan.

    Thanks for replies. How do I ring eBay? Looked everywhere for a number . Online resolution centre got nowhere as just kept saying out of 45 day time limit.

    Look up ebay on saynoto0870.com where you'll see various numbers.

    i think paying by creditcard, direct with a retailer, is the method to use whenever possible.
    i almost only use PayPal to take payment, rather than make them.

    Good Luck piggybankrupt. if you spend well via your Lloyds card, or bank with them too, you may be able to get them to support you outside of the normal S75 terms.
