Ebay not refunding money for item not received

Hope someone can help me with this!
Ordered a custom made oak tv unit on 27.10.13 from ebay - paid £229 (full payment) via paypal using my Lloyds credit card.
Various correspondence came via email from the supplier apologising for delay in delivery as they were really busy & had taken on more orders than expected and asked me to be patient on delivery (order had said normal delivery within 15 days of payment). I accepted this as I was pleased their business was going well and was happy as long as unit delivered by Xmas. Xmas week - 18th December was last email from them which stated delivery would be by 20th December - I had no reason to suspect it wouldn't be as they stated my unit was now finished and on the delivery schedule. Nothing arrived. Suddenly no reply to emails. Feedback for supplier on ebay suddenly changed from Excellent to 'avoid - looks like they've gone bust -item not delivered'.
Not to worry I thought - I paid by Paypal! Contacted ebay only to be told not covered by Paypal as only covered for 45 days from date of purchase (27.10.13)!!!
I had no reason to claim within the 45 days as I genuinely believed the emails up to 18.12.13 that delivery was iminent!
Now reading some info on Section 75 my protection through using my Lloyds credit card also seems in question as it went via Paypal not direct with seller.
How can I get my money back????

You'd probably have been better off on the ebay board.

I think ebay have recently revised their terms, but in the past you had to make a claim withing a certain number of days of purchase (now revised to a number of days from scheduled delivery date, presumably to avoid issues like you have - but with initial scheduled delivery 15 days after purchase, you would probably have been timed out even under the new rules)
Yes, it seems like you were timed out under the rules at the time.
You cannot claim against your credit card as you didn't pay by credit card. You paid by Paypal which was funded by your credit card. I presume there was no fault in the credit card funding your paypal account, or in the actions paypal took with your instructions, so there is no claim with the credit card.
Even if you did successfully claim a refund from the credit card company, they would try and reverse it with the recipient, i.e. paypal, meaning paypal will come after you for the missing funds ... and probably suspend your paypal account too!
Your claim is with the seller. If they have gone bust, you should take it up with the receiver, but I doubt you'll get much if anything.0 -
Unfortunately, you fell between a rock and a hard place.
Ebay wont refund you because you're out of your 45 days and your credit card wont because you went via Paypal. This happens quite a lot and many people dont even realise the implications of paying via Paypal.
Sorry...but I doubt anyone will help you. You might have had a chance if you had demanded a refund within the 45 days as they could have 'yanked' the money out of the other account and given it to you, thereby leaving the supplier with a 'debt' to Paypal.Debt Free! Long road, but we did it

Sorry but you won't get your money back.
Watch the deadlines and make sure you put in claims before the 45 days.
Be careful what you buy on ebay.
Sorry you've lost your money but I really don't think you have any chance.
You could put a claim in to the creditor but you'll be a long way down the list after the tax man and the employees.0 -
You need to call ebay. Filing an online claim will not work. Hang up and try again until you hear an Irish accent, because the Dublin call centre staff are able to use their own brains to override the automatic denial. The Manila call centre staff are not allowed to do this.0

Thanks for replies. How do I ring eBay? Looked everywhere for a number . Online resolution centre got nowhere as just kept saying out of 45 day time limit.Start by doing what's necessary, then what's possible, and suddenly you are doing the impossible.0

In cases like this...you won'e be covered by S75 nor buyer protection.

As a previous post suggests get someone with brains. Usually if this is a big thing and a company has gone under. Paypal/ebay make an exception to avoid the bad press of 100's of customers out of pocket with one seller.0 -
Stating the obvious, but Paypal works until it goes wrong and then it is an absolute and total nightmare. We used Ebay quite a bit and then I had a very stupid dispute with them. It was a strange world of going round in circles, getting email responses that bore no relation to my issues but absolutely no help whatsoever from them. Thankfully the buyer wanted to resolve it as much as we did and eventually posted me a cheque.
I've hardly used either Ebay or Paypal since.0 -

Ebay/Paypal have always encouraged buyers and sellers to settle disputes amicably amongst themselves before resorting to asking for 3rd party assistance from them.
Looks like you were trying to put the cart before the horse, and hence why you got into difficulty.0 -
In a similar situation - i told the seller i am happy to wait - BUT will still be opening a case on the last day available. I told them i will still be patient and wait - but they had until my case was due to time out, to deliver.
Item arrived in time - and i closed the case.
If you pay by paypal - you only give the seller the time stated by paypal for it to arrive. If thats not long enough - use a credit card.0
