Any chance you got a bump on the noggin and the 'black out' was in actual fact caused during the impact which is why you can't remember it?
You seem pretty certain about the 3rd party swerving into you which must have been seconds before the impact. Good recall for someone

Re: airbags the car will decide on the seriousness of the imapce.
Good (but old) demo here from Fifth Gear crashing two Renault Espace into each other head on. You'll see the modern one doesn't even think this accident is serious enough to deploy airbags and it looks a lot more serious than yours sounds OP

A lot of moderns wont deploy air bag if your stationary. I'm sure Ive already read this thread somewhere else.0 -

Now all im wondering is what happens after this automatism claim has passed, if no ones at fault because of this what would happen in regards to excess (because thats a hefty chunk of my insurance claim gone) no claims discount im expecting to lose and what would i have to tell my insurers next time about claims in last 5 years?
It depends on everyone involved:
Act of God - each party bears their own losses and so fault claim and lost excess for all
Cannot agree circs - 50/50 settlement each side can recover half their excess from the other side but fault claim for all
They win - they can recover their outlay and excess, just a fault claim for your, you lose excess
You win - you recover your excess and have a non-fault claim.
On the basis of you blacking out the last one is probably fairly slim in which case the 50/50 may well be the best result for you0 -
I bought the car 2 weeks before the accident thinking it was a safer car compared to my old mg zr, silly me thinking airbags were a safety feature. I didnt know they caused more harm than good. Thought id been misold the car but im not interested in pursuing this.

They're certainly a safety feature and a good one - if your face is going to hit the steering wheel at 50mph you definitely want your airbag to go off. We were both in the back of one ambulance getting checked over when i was asked what happend by the paramedics i said i couldnt remember, no witnesses, over heard her say to the paramedics she swerved into me.
Could the paramedics be admissable as witnesses if the other driver admitted liability to them?
Also as an ambulance was called was there a police presence? If so there should be a report. :think:0 -

An admission of liability doesnt mean anything. Joe public generally are not trained in the law of tortes to know who is legally liable or not.
What could be of use was if they could confirm what the parties said had happened but even with this then there is still a chance of (a) it being put down to being in shock/ dazed and confused and (b) you'd need to trace the paramedics and convince them to become involved0 -
