act of god?

Last thing i can remember prior to the accident is the car coming towards me and after that i can remember walking about talking to the third party then everythings a bit hazy just little bits i remember best way to describe it would be like being drunk (id not been drinking and not had a drink since new years) it wasnt until i was on the way to the hospital that i realised what happened.
Which doesn't really explain why you think you blacked out before the accident. I would have thought that applying the principle of Occam's Razor would suggest that it is mostly likely your lack of memory etc. is related to the accident rather than preceding it? Which would be a good thing and lead to less complications with the likes of the DVLA.0 -

Also the automatism thing makes more sense than it being an act of god if only my insurance said it.
I would put that down to shock rather than any existing condition.
Still go and get a check up at the doctors though.0 -
Re: airbags the car will decide on the seriousness of the imapce.
Good (but old) demo here from Fifth Gear crashing two Renault Espace into each other head on. You'll see the modern one doesn't even think this accident is serious enough to deploy airbags and it looks a lot more serious than yours sounds OP

Have the other party admitted liability?0

How would they know you blacked out? Were there any witnesses? At what point did you black out as you recall him swerving into the junction for some reason?
If you would ordinarily have been at fault for the accident however an unpredictable medical condition caused you to have it then it becomes an act of god and each party carries their own losses. Obviously you need medical evidence to confirm both the blackout and the fact that this was unpredictable.0 -
Does it appear that you did pull out in front of them and the argument is over why?0

Second this. I had a car accident a few years ago where the airbag went off when it didn't really need to (thankfully my face didn't hit it). My only injuries were burns and bruising to my arms caused by the airbag itself. You do NOT want the airbag going off in a minor shunt. In terms of airbags, be very glad they didn't go off - it is not a pleasant experience and they can lead to serious injury in their own right. they are good at preventing very serious injury in high impact crashes, but are not some light and fluffy cushion to take the strain in more minor impacts. Same goes for seatbelt pretensioners etc. if you have them.0 -
Does this 'blackout' have a medical definition?
It means little to me as it is far too non-specific - a bit like 'tummy-ache'.
Good be any number of reasons for it.
Definitely needs to be investigated.0 -

We were both in the back of one ambulance getting checked over when i was asked what happend by the paramedics i said i couldnt remember, no witnesses, over heard her say to the paramedics she swerved into me.
Lets unsure as to any medical definition im basically telling you guys what the insurance said to me thats why ive used the words "black out" and "act of god" im guessing my insurance are setting up for a back up incase the other parties insurance turn round and say no he pulled out
Now all im wondering is what happens after this automatism claim has passed, if no ones at fault because of this what would happen in regards to excess (because thats a hefty chunk of my insurance claim gone) no claims discount im expecting to lose and what would i have to tell my insurers next time about claims in last 5 years?0
