Stolen photo

Hi

I have now had numerous emails from this seller. She has apologised and tried to remove the photo, but can't as there are bids on the listing. She has managed to remove it from the gallery photo and added her own photos, but the fact remains she still is using my photo.

As her listing was for 7 days and mine 10, her listing is before mine and it looks as if I copied her!

My final comment to her is that I am not happy with anything other then complete removal of my photo and if that means her ending her listing, then so be it. She has done nothing.

I reported it to ebay first thing on Thursday morning and NOTHING. I haven't even received a standard reply. In fact, I have reported it more than once, but when will they do anything?

    I found that when I reported a listing without bids on it was removed very quickly but the ones with bids on took ages. One didn't get removed until after it had finished. I just kept reoprting them, live help were no use at all.

    if its not copyright then you can only politely request to have it removed.

    If DonnaP took the photograph then it is her copyright, if reported to Ebay, they should remove it, but not always in time and there isn't much more to be done to get it removed quicker. There is no registration process for copyrighting, as soon as someone "makes" something new, the copyright of that item is theirs. It could be suggested to the "Photo borrower" that as the photograph is owned by you there is a charge for using it.

    I understand where you are coming from but it is something that has never bothered me ..... and yes someone has pinched a photo off my auction. I didn't report it but we are all different and if it bothers you then ebay should quickly remove it. Hope it works out the way you want it to.

    I reported someone for using my photo and Ebay sent them an email after their listing closed. I got a snotty email from the other Seller demanding to know why I had reported her.

    If she had asked to use the photo it would have been okay, I don't have a shop, I am a private seller, she bought an item she didn't like/didn't fit and simply relisted it.

    At the end of the day it is only a photo.

    Neither really.

    The respectful thing would have been for the other Seller to have asked if it was okay for her to use my photo. I would not have had a problem with that.

    i find it best to edit the photo and put some sort of slightly visibile logo across it........ you can find other sellers also do the same

    I have started using auctiva and it has a watermark facility - I think I might start to use that

    It's not recognised as copyrighted by eBay. I once sold an R2D2 Droid, somebody in china completely cloned my auction, the pictures were taken in my bedroom!

    When I reported it to eBay they said they couldn't do anything and I should have put a small logo in the picture so I could prove it was mine! Never mind that this person was obviously trying to defraud someone..
