  • I too have not received any responses for the email I sent to T mobile last week regarding the changes of terms and conditions. I might send the email drafted at #44 again if I've still heard nothing from the company this afternoon using FAO suggested by other members.
  • Hi all. I've been following this for several weeks and have just decided to take the plunge to follow this up for my wife's orange account. I'm with them too but I only have 3 weeks remaining.

    I have just sent off email in post #44, without reading back through the whole forum could someone please advise of the post numbers of the second. third and fourth templates to save me a little time please.

    On another note I called cs last week to give my 30 days notice to leave and the retention deal they offered was an absolute joke. It was just a deal off their website but without any Quidco / TopCashback. So much for thanking me for being a loyal customer for the past 18 months.

    CISAS letter received EE have until the 20th to respond.

    Lets be honest - how many customers does EE have ?

    This is the reason why they don't give a fig about the miniscule number of customers who are currently complaining.
    They will just continue the way that they are - until a catastrophe hits them......

    Got my response from CISAS, EE have until the 20th to submit their defence. What happens if EE don't submit their defence by that date?

    People who have received acceptance from CISAS, did you get attachment of the correspondence to EE.

    PDF letter I got says "We acknowledge receipt of an application for adjudication by the customer, a copy of which is attached for the attention of the company."

    But only the letter attached, no second attachment.

  • Hi Random Curve, just gone to submit my CISAS claim and noticed a few mistakes in the "post 30/10/12 summary piece (post 267):

    1. My first paragraph ended (after removing irrelevent bits) with "as per clause 15.1B and 4.3 Contract:" - think it needs to say "of the contract".

    2. Clause 4.3 ended "
    However this option does not apply if:" and then stops... think that needs removing.

    Thought I saw another too but lost it now.

  • In addition to above, I have just readied my Appendix one to send to CISAS and am a little concerned with the content.

    Paragraphy 4 (ish) states:

    " It is clear from the above that the maximum amount that EE can reference to increase my contract by has increased from the lowest inflation rate published to the published RPI. Therefore as the absolute amount of the increase can now be higher the change must be to my Material Detriment."


    But the term on the contract pre-change says:


    "
    4.3.1 we give you written notice to increase the Charges (as a percentage) by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices or any other statistical measure of inflation published by any government body authorised to publish measures of inflation from time to time, and published on a date as close as reasonably possible before the date on which we send you written notice;"


    To me, that clause doesn;t say they MUST use the lowest measure, it simply says they can use any statistical measure (of their choice) and that the increase must be lower than than measure.


    If thats the case then were is the material detriment because under the old or new terms they can use RPI as the measure so nothing has changed.


    Its not that I don't think there is a case for material detriment and penalty free cancellation because of this, I just think the above isn't it.[FONT=&quot]
