UKPC only see court when they are taken there themselves...
However to this OP - why not use POPLA and cost them money to cancel this charge in any case. And edit your posts please regarding the driver.0 -
to be honest, I got told off for hijacking a thread earlier! oops
once I'd got my head round all the terminology, and read through things a few times it started to become clearer. Seems quite simple at this stage, feels like I'm missing something! I'm concerned it will get overly complicated as it progresses.
Still don't fully understand why the method has changed from ignoring all the threats to appealing. Do people still successfully use the 'ignore' approach?
If you read other Moorgate threads you will see UKPC always send a delaying letter unless you enclose copy receipts - so if you have them, consider including copies of them when it is appeal time. But you'd be saying 'the driver was a customer of xxxxxx store and here is their receipt' of course - no 'me, myself or I' after going to the trouble of waiting to appeal as registered keeper! And you'd add the usual winning words too in order to show that you would win at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You'll get good news from POPLA and a letter of apology from UKPC.
You could then place the letter of apology on your dashboard in clear view of the ticketer for when you next 'leave site'.0 -

the BPA guidelines say that any PPC should issue a popla code with any refusal
these companies dont play by the rules, not even when its spelt out to them in newsletters by the BPA and dvla
so what they do do is not always what they "should" do
yet they expect everybody else to adhere to the "rules"0 -
They should do - and you should NOT have to ask for it. But we've seen UKPC reply with a time-waster letter asking for proof you were in the retail park.
You could counteract that by being really proactive, looking at the letter they've sent other people delaying the matter, and saying in your first appeal something strong like:
You have no evidence of the driver and passengers all leaving the site and in any case your signage does not include a site map boundary to explain within your alleged 'contract' where the 'site' begins and ends. UKPC has made no loss in this matter whatsoever and you have no locus standi in this car park. This location appears to be a cash cow for UKPC and I know that your site agreement with clients usually has a 10% revenue sharing clause which gives the lie to any claim from you, a mere agent with no title, that your extortionate 'charge' is wholly for some jumped-up 'loss'. I also have a screenshot of your website where it admitted in the FAQs that you make all your money from your PCNs and you call it 'revenue'!
I also know that you are economical with the truth on your website where it says ''Do we really take people to court and win? Amateur lawyers posting on internet forums often advise people to ignore parking charges, claiming that they’re not enforceable by law. This is bad advice. In fact Parking Companies take people to court every month and in most cases the judge finds in our favour'' You quote cases that are not yours, all lifted from one court list from one month, years ago. I also believe that UKPC have never been to small claims court except where you were taken there by Trading Standards and for trespass - would you like me to point out your tainted TS history to your client at Moorgate Retail Park?
My challenge is based on the assertion that your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner. In every case where a motorist has raised this issue, POPLA have accepted the appeal. You are therefore fully aware that there is no prospect of your charge being upheld. If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you and my time at the court rate of £18 per hour. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Do not waste my time and yours sending me your template letter that asks me to {quote from the letter others have got}. If you do I will immediately report you to the BPA and DVLA because I have nothing further to add and the driver has no receipts for that day. As the registered keeper, I have the right to appeal to POPLA now and have stated my appeal points above. Now your two choices are: POPLA code or cancel, NO TEMPLATE TIME WASTING REPLY.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They tried the delaying letter with me - it's to lure you into thinking they are genuinely examining your case to have the charge quashed.
You'll get one back from them stating that the charge stands and that is when they give you your POPLA code.

To answer the question which you posted on my moorgate thread regarding signage, I was merely using the soft template appeal at this stage. I have been back to check the signage and it seems that as moorgate has always been free UKPC have spotted an opportunity to get people for leaving site.
There is plenty of signage on site but I did note there are no diagrams or explanations of what the site boundary is, also the text saying 2 hours free is HUGE, while the text about leaving site is tiny.
Have you checked the photos that they have on file? The ones I have seen just seem to show the car legally parked in a bay and a couple of random shots of blurred signs.0 -

Thanks Traderdave, I was just wondering if you had spotted something in particular with the signage. I too have been back since and noticed a few things that don't seem to comply. Probably not worth getting hung up on the signage issue anyway.
As for the photos , I've not checked, wasn't sure if it was safe too?0 -
