    Landlord still needs to apply to court for a possession order. However if they have evidence you gave notice they don't need to send a S21 and wait 2 months they can apply immediately.

    I paid a deposit on an AST, as such, by law, it must be protected by a government authorised scheme.

    You are right! I don't know all rules/law. I myself am a landlord and make use of a lettings agency, I have all insurance in place, etc. No headache.

    Serves me right, though! Am a bit of a WUM - lol. It's all good. Like I asid, the place is fully furnished, I don't have much here. Hopefully, the new role gets sorted soon, can then get the movers in and expense it :)

    The relevant part of the Housing Act is here:

    This seems to say (if I am reading it correctly) that the LL can take tenant to court under Section 5 as the surrender means the tenancy has ended.

    However, email of surrender may not be sufficient plus no mention of having to use Section 21??????????????

    Unless someone has more expertise about this then a call to Shelter to clarify may be necessary. For your sake a knowledge of what to expect and the time scale would be useful.

    Think u missed the irony of someone not knowing the rules, complaining about someone for not knowing the rules.

    Jesus, ur a landlord?! Heaven help your tenants. Wish I hadn't bothered helping now. Some people deserve what they get.
