i get severe disability premium, ESA and DLA middle and high
i think councils are allowed to set their own rates when it comes to contributions towards care.
my late FIL had a state pension, p[rivate pension, DLA middle and high and industrial injuries benefit and still didnt pay anything towards his 3 times a day carers0 -

Yes that it true regarding each Council's charging and it will also depend on Disability Related Expenditure. But more and more Councils are assessing in Benefits for charging. And many people have not informed the fairer charging teams (which are often private like Serco managing it) that their circumstances in regard to benefits have changed.
The bottom line is they are strapped for cash and if they can get it back in understandably they will. Our authority does not mean's test i.e. income at all they automatically take SDP, and 1/2 AA/DLA across the board. This might seem unfair but they say it brings them in more revenue.
At the end of the day whether people like it or not SDP and DLA/AA is to pay for care and costs arising out of disability which is why you can offset DRE.Think of all the beauty still left around you and be happy - Anne Frank :A0 -

It is very rare for LA's not to take into account SDP when charging these days.
Charging is still based on the minimum amount the government says you need to live on plus 25%. So that is a major factor when discussing it.
SDP is offset against other benefits when paying anyway so often you don't get the actual £50 odd in real terms you have an underlying entitlement to it.Think of all the beauty still left around you and be happy - Anne Frank :A0 -

Anyway OP what I was trying to say to Nanny above which may help you and your Aunt is that loosing SDP may not mean she will in real terms loose the whole amount i.e. £50 ish because she may only be getting a proportion of it in the first place depending on circumstances.Think of all the beauty still left around you and be happy - Anne Frank :A0
