    The situation is clear when it comes to SDP if anyone claims Carer's allowance whether you live together or not it is lost.

    I don't think it will affect Pension Credit's but I am no expert in that area.

    You need to separate out things here, regardless of whether you reside in the same house or not.

    SDP is cancelled if anyone claims CA for you.

    The living together situation may affect different benefits in another ways.

    OP you say she is being penalised perhaps if I explain this it will give you a better understanding.

    SDP is awarded for someone who is totally single and has no carer in order for them to pay for extra help. If she received care provided by the Local Authority for example it would be taken in charges. In our authority you automatically loose SDP and 1/2 DLA daytime rate for care provided. (Although you can offset disability related expenditure).

    BUT and this is the big difference when someone claims Carer's allowance the things you can primarily offset against charges like employing a cleaner/shopper/gardener etc. are done by the full time carer on CA.

    I hope that gives you a better understanding of why SDP is cancelled out by Carer's allowance?

    Personally I would advice staying in your own accommodation and providing the care on carer's allowance, that way you get to keep all your existing benefits and you are in affect working by caring for your Aunt.

    Another option if she needs this 40 hours per week is for a Social Services assessment to be done and if her needs were there, then she could receive a Direct Payment for care (please note comments above re charging) and then employ you as a Carer.

    Aren't there rules about employing family members as carers?

    Yes but only if you live in the same household. And there are discretions in this regard but only in extreme circumstances.

    Having been a DP support worker in the past I've only known of one case where that happened and to be honest I wouldn't have gone alone with it. But it is really down to the Social Worker in that regard.

    I think the bottom line is you have to see that your Aunt is not being penalised that extra payment of SDP is to pay for care. If someone therefore claims CA's allowance and it isn't just the CA they get because they also get full NI contributions as well. This is being provided by the State so it would be paying twice.

    Having said that I do believe very strongly that to be expected to provide 35 hours a care a week for the amount involved isn't quite right. But that is the current situation and I can't see it changing. That is why I flagged up the DP option but she would still loose the SDP in charges.

    Yes but do you get SDP? And even if you do what about DRE which as already mentioned is a factor.
