if both are claiming CA, then they must both be receiving at least the middle rate care DLA.
the severe disability premium is still paid if the 2 people that live together are both disabled

No. The mother receives LRM, and the daughter receives MRC. The mother claims Carer's Allowance + JSA, with a carer premium.

The daughter receives MRC + SDA on top of the JSA payments.

Why is that my Aunt gets Pension Credits that she loses the SDA??

I know it's complex, but thanks for your + everyone's answers!

As has already been explained, the severe disability premium is lost because someone is claiming carers allowance (or will be) for her.

I guess that what you're saying is that obviously they'll check up on people, but there is no way her health condition will improve - she certainly won't be playing golf. What I meant was that she would not be introduced to PIP (already sought advice) and that her indefinite awards are SAFE as long as her health doesn't magically improve!

Thanks for your answer tho :)

    That's OK.

But it is wrong to say that ANY benefit is safe from being reviewed by the DWP no matter what it is or how old the claimant is. If it was the case that for all disabilities if they never improved there would be no checks. There are. As an example my wife is 69 and extremely disabled yet she is re-assessed every 2 years (was every year) for her Attendance Allowance claim even though medical opinion is that she will never improve and will only get worse with age.

Never say never is the way to think about how the DWP view benefit claimants of all ages and with all disabilities.
Under PIP they intend to review people even though they may have given the DWP a form signed by their doctor that states that they have a terminal illness and are likely to die within 6 months.

are you talking about the severe disability premium or severe disability allowance as they are different things.

no new claims for severe disability allowance have been made since 2001 and can only be claimed until pension age.

if that is what she has been claiming, then it has been stopped due to her age and not because you are claiming CA

The only income she receives is the Basic State Pension, Pension Credit (around £8 a week) Housing Benefit and Council Tax Reduction. HRM + HRC DLA. How could she lose out on Pension Credits? - (this is what entitles her to HB/CTR) That means she could end up with nothing? (bar DLA income)

If your aunt is only getting £8 a week in Pension Credit it means that her total assessable income is £8 less than what she needs to live on when calculated against all of the allowances and premiums that she is entitled to.

Those allowances and premiums will include an amount, currently, as she is in receipt of HRC of DLA, and NO ONE is actually claiming Carers allowance for her. That premium is worth £59.50.

However if someone starts to claim Carers Allowance for her she will lose that £59.50 a week premium. In other words the amount she needs to live on will be reduced by £59.50. As she is only getting £8.00 Pension Credit, it will result in that Pension Credit being taken off her as she will be receiving income of £51.50 a week more than what her needs dictate.

Sorry, no, I have been getting mixed up. To clarify I am meaning the Severe Disability Premium paid on top of Pension Credits. Not SDA benefit

    Thanks

Sorry to say.....but I simply can't understand that. She's losing benefit so how will she be receiving £51.50 a week more if the Severe Disablement premium thru pension credit is lost due to me claiming Carer's Allowance?

she will lose that premium from her council tax calculation, but she will also lose that premium as income too.

youre doing your usual job and trying to scare people that font know anything about benefits.

    OP...
Andy is a troll who has NO life and seems to spend all his time trying to confuse and scare vulnerable people whilst his own daughters defraud the system.

i suggest you put your efforts into making them do the right thing instead of causing people that are asking for help, more distress than they already have!

you need to stop worrying about what these 'friends of friends' may or may not be getting.
i suspect that someone along the line has misinformed you.

it is correct that your aunt will lose the SDP once you claim CA.
her council tax benefit should be unaffected unless there is some other source of income

I wonder if that explains what the OP said earlier about losing council tax reduction? Although, I thought that people receiving any amount of pension credit, received full council tax support?
