This particular part of their T&C's is unenforceable. Law always trumps your contract T&C's.
And no need to go to court, there is a formal complaint procedure that I will have to follow.
Then go ahead and follow it up, no point just talking about it.

The difference is that we have ethe option to leave our shopping and walk away if we like. We're not obliged, contractually or otherwise, to continue to shop with a particular supermarket or buy a particular brand of food/drink etc.
Don't forget you had the choice at the start of the contract to buy a phone SIM Free and outright and pay a lower monthly rolling contract with 30 days notice, or get a a contract with a minimum term in return for getting a handset subsidised.
You had the choice then to not take the contract, the T&C's that allow this rise were acceptable to you then why are they not now?0 -
I honestly don't care about their 2.7% increase. What I care about is the 50% increase to international EU calls. This may end up costing me around £30 a month extra.

5.4 You can end this Agreement without having to pay the Monthly Subscription Charges up to the end of any Minimum Period you have left, if:
(a) we apply an increase to your Monthly Subscription Charges other than an RPI Change; or
(b) we increase any of our Out-of-Bundle Charges in a way that would have had the effect of increasing your total bill (based on your usage in your bill in the month prior to our notification) by more than 10% if the increase(s) had applied for the whole of that month's bill.

Just been in touch with O2 myself telling them I want to cancel.
They quoted that RPI increases were covered in my contract so I hit them with the fact that the call charge increases weren't included and under CISAS regulations these represent a material detriment to me meaning I can cancel without penalty.
As soon as I said that they rolled over and i'll no longer be an O2 customer in 30 days.
Off to EE where my £37.15, 24 month contract will be replaced with a £22, 12 month sim only contract which gives me an extra 4GB of data and is a 4G one0 -
Got the email yesterday informing me of the price rise. O2 say they are raising prices because of inflation but at the same time don't seem to realise that by doing this they are adding to inflation! dimwits. Luckily I'm out of contract so think I'll be looking elsewhere.0

Not according to CISAS guidelines which state that if any call increases mean an increase in the price of your bill that leads to material detriment then you have the right to cancel without penalty.0 -

That tariff may well suit your usage pattern and if it does then go for it, it would be daft not to.
This month I have used 291 minutes and 134 texts and 122mb of data, however some of those texts equate to mms, how much would gg out of bundle calls have cost me? and I still have calls to make before the month is out, also consider that gg uses spare capacity on O2 it's not just about coverage, it's about access to the network when required, but of course GG Tesco and all the other networks and virtual networks are sutable for many users .0 -

Which means if somebody can show that for the preceeding 3 months or so they were using out of call charges which had increased then they have a case, if not they don't have a case I think you may find.0
