    You don't seem to be denying that there is a possibility this video exists.

    If you say you were on crutches and struggling, then why are you worried. You're bothered about maliciousness and breaches or privacy, but the real issue is you.

    Can you walk or can you not?

    Are you claiming fraudulently?

    If you are then it is her duty to report you for scamming the system for however long.

    These statements based on your reaction. If you know you are claiming correctly then you know this video cannot exist as you cannot do the things you are said to be performing in the video.

    If your neighbour has got the one tape of you walking and it has aready been recieved by the relevent authorities they may of already been investigating and got you on their own tapes since July.

    Being videoed doing something that if you did it every day would reflect a change of circumstances can seem like an easy win for the authorities, and indeed some claimants are dealt with inappropriately by the system in this event.

    If the authorities do have independent video, it is important to ask what context this is in.

    Have, for example, they observed you for a couple of weeks, and 29/30 times you were not doing anything 'wrong'.
    If you've said you have a good day every couple of weeks - this would be a valid defence.

    In general, decision-makers - and the tribunal can take into account every bit of information they get - nomatter what the source is.
    They are supposed to properly weigh it, depending on the source.

    It depends on your condition, fluctuating or not, and whether you have said you are a 24/7 wheelchair user, or use it variably.

    Mobility component is not dependent on being a wheelchair user, but difficulty with mobility and walking is part of the criteria.

    An amateur video is not worth much, legally, as the DWP would need to film you themselves showing that you appear fit and fraudulently claiming.

    Only you know the truth of your condition, but if they decide you are fit, you will need medical backup to appeal this.

  • I used to work near an old DSS building (early 90s)- we nicknamed it the road to Lourdes as those being wheeled to the office or hobbling there on crutches - used to suddenly regain the use of their legs once they had crossed the road and were out of sight of the building following their interview.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    The criteria of 'reliably, repeatedly, and safely' needs to be applied to the descriptors when answering the questionnaire.. this is following a review into fluctuating conditions.. sorry I can't reference it but read about it on a 'health charity' website.

    So can you repeat the walking? etc..

    I use a wheelchair outside the house but 'walk' inside grabbing furniture, using sticks etc.. you just need to tell DWP this.

    I can walk in the garden (adapted access) and chairs positioned around.. again dwp are told this but then have to rest for prolonged period and can only do this on a 'good day'.

    Obviously get some professional advice, but I would be updating the dwp if your condition has changed. Just explain the fluctuating nature of it... and that now you can walk short distances using aids.. how does it make you feel? increase in meds? increase in symptoms etc etc? how often you are able to do this etc? If possible get some medical evidence..

    I am always worried about how people see my disability as they only see the 'good days'.. like your day in the garden and not the days in pain.

    It's tricky but we have to 'prove' our entitlement and with all the publicity on benefit fraud (a whole different issue) the public are obviously fired up against wrongful claims so there is a greater chance of being reported.

    Yes photos, videos even just a verbal statement can all trigger an investigation.

    I hope thsi si resolved soon for you.. it must be causing stress

    Only you know what your disabilities are and what that means you are physically capable of. Only you know what you declared when claiming DLA and if that is an accurate account of your mobility issues. If you were truthful and have not lied or misled then you have nothing to worry about. If you have lied or misled then you will have to face the consequences. If you mobility issues have changed (peoples conditions can improve) then speak to see if your claim should be updated.

    If you have been truthful and this so called video shows nothing that they already know about you then why are you worrying. The only person winning is the smug neighbour and the mental anguish he or she is causing you.

    Do you have a local DIAL that you can talk to?
