In which case they are no different to anyone else looking to downsize. In fact probably better financially able to pay the extra than a single person on JSA.
The only problem is the tens and sometimes hundreds of thousands spent on modifying a property to meet that disabled persons need. If they move the Council will have to spend that money again modifying another home. The home they vacate will only be of use to someone with a similar disability but who is willing to pay for the surplus rooms.These are my own views and you should seek advice from your local Benefits Department or CAB.0 -

I agree if modifications to a property have been made that it would be totally counterproductive to make that person move or indeed charge them for any extra rooms.
However there must be many more properties, such as Nanny's that require absolutely no modifications. There will always be exceptions. There are many conditions that people consider make them disabled that require nothing special in accommodation.0 -

You have seen nothing yet reg, believe me. One of those to who I think you are now referring reckons she is some kind of 'professional' in the field of Mental Health! It beggars belief. If she talks to any of her 'client group', in anything like the oppressive way she responds in postings to some on here. I really dread to think of the 'care' they are being subjected to!

I applied for my refund via telephone, was told to put it in writing, having done this i left it 2 weeks after i knew that my housing office had received my letter that i sent recorded delivery i rang them again, i was told that i did not qualify for the refund, i asked why this was, was told that i was not on continuous hb from the qualifying date, this i knew was untrue, i told them that i had been, i was then told to send them in evidence of this, i replied that i have all the evidence here to provide them and that i would send it into them, their reply was good you do that, very rude i thought, i then asked as to why when i first telephoned them that they were not telling people not only to put it in writing but also to provide them with evidence, they could not answer my question, i have now submitted via recorded delivery signed for another letter with my proof, i am just glad that i have never since i have been a council tenant thrown any conformation away from them, so now i await what other rubbish they try and find so as not to pay me my bt refund, along with this i have since the start of jan this year been waiting for a reply for rent that i have actually overpaid, till this day i have written them 1 letter and 4 emails, yet i await their reply, they do not like giving money back but would soon be at your door if money was owed to them. must ask them for interest on this lol0

Hi I'm new to all this , I live in cancil property and have had housing benefit I had to move because of a police situation all the police paper went to the cancil adking them to move me , 1996, by may 1997 I still received housing benefit and council tax benefit. When the council moved me where I am living now . my jealth has got really bad and I am having to pay £42 per week because I have spare rooms. I do not have a carer but friends and family who look after me I get DLA and ESA , can anyone tell me would I qualify for any rebate ? I really don't understand many thanks in advance . god bless0

It's in today's Guardian and Independent -the claimants have got to be repaid, and no bedroom tax deducted.
Tenants may even make a profit on this, as any discretionary payments they may have had apparently don't need to be repaid (can't post a link at the moment, but it's on their websites).
The average amount to be refunded is £640.

Thanks for answering so it looks like I won't get it as even though I had to be moved by police recommendation letter to council 1996 and there were no property's:( until may1997 I will still have to pay over £42 for rooms0 -
abd what if they have claimed continuously since that time, but have moved properties withing the same housing authority?0

It has to be the same property and housing benefit needs to have been paid continuously since 1996.

If your friends and family act as carers do they stay overnight? Even for a few nights a week then you might be able to claim an exemption as you require the additional bedroom for overnight carer. The carer or carers do not have to be paid carers they can be family or friends so you do have carers.
The current loophole is for those who have remained in the same property continuously without a break in Housing Benefit since 1st January 1996 at the same property. The Government plan to close the loophole on 3rd March 2014.These are my own views and you should seek advice from your local Benefits Department or CAB.0
