    Maybe, maybe not. But doesn't seem like the usual Andy, to subtle and plausible to start with, so unless Andy has become much more adept at trolling it seems unlikely to be him.

  • I said on post 122 that Keith should ask his Uncle Andy for help, and though I agree it's a change of style for Andy, there are some clues. There've been a few Newbies that I've suspected might be Andy, or those who were bored in the school holidays, but you just can't tell - for sure!


    Strange though that Keith has been noticeable by his absence!

    Hi, I have only just logged back on to the thread today for the first time as there is still no update from the council.

    I'm not sure where to start as there have been a lot of replies and posts, firstly I dont get the reference to "Andy" but i'm not Andy and this is a genuine situation that I have got going on.

    Just to refresh on my situation, I gave my mum the money to invest because I was going travelling the next day, I could have canx my travels but it was booked with three other mates and obviously at the time I didnt think much to giving my mum the money and investing it for me. I suppose technically the money is now my mums as it is in her name.

    With regards to the property I rent to my mum, it is on a repayment but this is because I initially lived in the property as my residential house. I dont know what the interest only element of the mortgage is but the rent and repayment is pretty much the same. I do have permission from the mortgage to let it out and they know its let to my mum as do the council.

    With regards to my son, he does not live with me but I do have him every weekend and help with money to his mum. Whilst I was away travelling I gave my mum money to help look after him for her costs and incase he needed anything important/emergencies. My son did not live with my mum, he only stayed over sometimes at the weekend occasionally during the week etc.

    I dont mean to offend anyone with this comment and it wasnt even my plan initially, but isnt the idea of a BTL property to be for someone else to pay the mortgage for you? My mortgage is about 650 and I rent it out for about 650? I know its the HB paying the money but this is allowed? my mum doesnt get full HB and either she or I pay the difference.

    I never meant to hide or give bits of information at the start, I just thought we were being investigated for something completely different. I was honest and came forward with all the details once we had the meeting with the council.

    As I've previously said I have learnt from this experience and will be declaring the BTL to HMRC.

    With regards to the house I owned and then sold which I made the money on, that was on a BTL mortgage, I rented out two rooms which covered the mortgage. Again, I did not declare this to HMRC before people start having a go. I did not make any money as two rooms only covered the mortgage so I was not making an income.

    My mum lived in a rented house with her partner.

    I appreciate everyones help and advice.

    Would you sometimes pay the difference to a stranger who rented from you too? I would assume not, so therefore you renting to your mum is constrived as you are not treating her the same as you would an individual you didn't know.
  • HMRC are very unforgiving...they charge interest on incorrect payments as well as a fine. (I filled out one section of SA incorrectly and found out to my cost).

    However for rental income, the expenditure and offsets must all be declared...you cannot elect to 'not bother' as it is not enough.
    So you have to say you receive say 12000 pa for rent, then offset the management costs, essential repairs, interest only on mortgage etc ...to show you received a net profit of say 1000. HMRC like to be able to tie up all loose ends.

    It sounds like you are either winding people up, or you have been trying to play the system and are now claiming innocent. You would not have investments and a property portfolio if you had no clue about life.
