claim form

hi,
please can anyone help,i recieved a parking charge back in august from parking eye for an overstay of 16 mins.maximum stay was1 hr 30mins. i was a genuine customer( no recipt but i do have bank statement to prove) im diabetic and have to check blood sugars before driving,they were low so i had something to eat and sat in my car in the carpark until i felt well enough to drive an for blood sugars to rise so i would be safe to drive.i hadnt realised at the time that i had overstayed the time limit.the carpark was not busy so i was not taking the space of a potencial paying customer! i ignored all correspondance but now ive been issued with a claim form from the county court bulk center. i intend to dispute the full amount. but not sure what to put down in the defence box? does it need to be more formal than what ive just written here? do need to say.dear sir/madam?? thank you. ever so grateful for any response.:)

    dear me , you could have easily got this cancelled back in august or soon after if you had come here for advice instead of ignoring the letters, all ignoring the letters has done is made this court case happen and caused you much more hassle now

    I suggest you read the NEWBIES - READ THIS FIRST sticky thread at the top of this forum until somebody with more knowledge than me can answer your points or give you helpful links

    sorry we could not help you 6 months ago when this could have been easily cancelled at popla

    am sure people like coupon-mad will have a better reply than mine for you, just a shame its come to this, which is why we advise people NOT TO IGNORE these letters

    I would also email the parking prankster (google his blogs) and see if he or somebody he knows can help too

    I would also put in a strongly worded complaint to the shop or landowner too, mentioning the EQUALITY ACT 2010

    Same as here then, start your research and acknowledge the claim as a priority (the ack is not your defence):

    Post back when you have read the linked threads and also have gone to pepipoo and read back a dozen pages, clicking on and learning from every PE small claim thread. That's the way to inform yourself fairly quickly, may take a few hours of solid research but it is important you write your defence and that you read enough background of other people's experience of this, so that you can confidently defend it and face them at a hearing if it goes that far.

    You also need to complain to the Store Manager and CEO to get it cancelled - can be done after court papers if you are assertive (read the 'Successful complaints about PPCs' sticky thread here on MSE!) but don't miss the 28 deadline to get the defence submitted.

    hi, thanks for that coupon mad . ive now sent emails to parking eye and homebargains and customer service. had email back from homebargains asking for PE charge details etc. and that he will look into the matter havent heared anything back yet. im keeping my fingers cross! i still havent filled in the defence form to court yet but know i should just incase homebargains will not cancel the ticket. i will let you now if i hear anything back. you all have been so helpful helping everyone who has asked for youre help, so glad i found this site.

    anybody know if this is the normal procedure,i emailed homebargains asking them to cancel the PE charge,he has emailed back and said he has written to PE asking them to cancel ..does this sound promising or are they just fobbing me off??.im going to post my defence letter to county court today just incase!

    No, that is positive. Keep a copy of that email, as it will also form part of your defence so make sure you include it.

    Definitely still defend in time, and they probably won't let it lie. You should expect a 'Without prejudice' letter from ParkingEye begging you to at least pay them £50 or so. You can find how others have responded to that 'offer' by searching this forum for 'prejudice' as a keyword.

    you were right,recieved a "without prejudice save as to costs"in the post today.they require me to pay £50 within 7 days . im going to read through the threads and information you gave me now.thanks again

    should i email homebargains back and say that ive had this letter off PE, last email i had from them was to say he had written to PE requesting them to cancel the charge. im now not sure on which information PE is acting upon as i sent email to them direcly and to homebargains last week and ive also sent the defence form back to court on tuesday this week..probably to early for them to of had sent back on the information off that? bit confused now!
