    hi,
    havent heard anything back yet ,but i have received aknowledgement of receipt of defence from county court. just a matter of waiting now i suppose!

    still waiting for responce from PE ,dissapointed with home bargains i have sent three emails to three different persons not one has bothered to reply.should i do anything at this point or just sit and wait untill i hear from someone? i know PE has had my letter because they have signed for it last wednesday.be glad to hear if anyone has any suggestions thankyou.

    hi,just an update ive heard nothing at all from PE or home bargains! last ive heard was the demand for £50 without prejudice save as to costs.do they normally take this long to respond? i sent them my letter on the 20th of last month.do you think they will carry on with this claim? thanks
  • Has the time period for their "offer" expired.

    hi consumer rights, yes it has expired they gave me 7 days to pay up ..letter theu sent me was dated 14 th of january. thanks for replying

    they also state if i dont pay within 7 days the claim against me will remain. home bargains have assured me that the ticket has been cancelled but they can do nothing about the court costs? but im wondering where does this leave me now? are they taking me to court for the £50(save as to costs) or are they going for the before cancelled ticket of£165??

    They do sometimes carry on a few months later so don't throw any letters away as you may need them as evidence. The Court may write at some point and say unless PE pay the next fee for the hearing, the case will die. After that then you should be safe if PE don't continue. You can always ring the Court, in the end, to ask the status of the claim around Easter - but this is far too soon, just a fortnight after you responded.

    WHO KNOWS WHAT PARKING EYE WILL DO - THEY ATTEMPT ANYTHING TO EXTORT MONEY HOWEVER THEY CAN.

    The letter is purely a means to try and coerce and scare people into paying and is specifically designed to be sent normally when the original parking charge has been cancelled by Parking Eye's client, the landowner.


    Their Eye01 template letter reads that should you fail to pay their "without prejudice" associated costs by the specified date, then "they are confident" they will win their costs and file for the full claim. So good luck to them as the original parking charge has been cancelled by the principal and court costs are only awarded upon a successful outcome by a party based on the original claim filed (ie. the parking charge).

    In fact I believe Parking Eye have already tried this once before and failed P Heggie stood his ground and won in court after their kind offer to settle was declined.

    I hope your initial defence submitted was sound enough - did you get any help off forum?

    As you are covered by the Equality Act in this instance - how do you feel about raising a claim yourself to Parking Eye and see where that leads.


    Oh dear - sorry Parking Eye - you already think there is a vendetta against you.
