    in theory, yes.
the DWP see it as a totally natural situation, that someone would live with a parent/close relative and that this person would be allowed to live rent free and be given every support merely because of the fact they are related.

for a 'stranger' ( ie someone not related) to do this, is more than slightly suspicious.

ive never said stranger though. Others have assumed that and ran with it rather than accept what was said and advising on that basis.

i haven't said stranger you have. I have said don't want to say and given reasons why.

Exactly - so they have a relationship whether its friends, family, parents or whatever. If its a sibling then it's less likely they'll be investigated than a "friend with benefits".
  • Well the thread has gone on for quite a while without many clear or straight answers although I think I have got the gist of what has been going on in reality

Threads do this sometimes when things are introduced and assumed. Glad you've got the gist I think I've got the reality of your tax query too.

In the absence of answers to the questions asked by the people who are trying to help you, what else could anyone do but make assumptions?

Well I, for one, can't be @r$ed with this thread any longer. Folk asking for advice on here shouldn't expect everyone else to play a game of twenty questions.

I was asking for advice on specific query and assumption were still made after I answered. Thanks anyways

pn orser to answer that specific question, you were asked time and again what the relationship between the 2 individuals was.
you chose not to say ( for whatever reason) but the answer to that question would totally change what advice would be given.

There's nothing to find in the partner living together thing and neither is claiming means tested benefits so why would it matter if they were treated as living together anyway.

But the claimant is claiming a means tested benefit - the earnings related JSA.

If she were only on non means tested benefits, such as contributory ESA or DLA, then she could have millions in the bank and still be entitled to the benefits.

BUT, any means tested benefit is subject to income and savings, and that is why you have to declare them all, regardless of whether you think it's their business or not!

I'm still confused as to their relationship - either they are friends only or they are involved as a couple.

If they are aaying they are just friends, then they will need to show this, and explain what is going on with these bank accounts. If they have what would be construed as a relationship, by reasonable people, then that is how they will be classed.

To be honest, if you want advice from a public forum, you really need to say it how it actually is - and it's a dead cert the DWP won't put up with all this hedging when they interview her!

    Lin :)
You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
