Benefit Investigation

Why would another person supporting them mean they're not entitled to any means tested benefits? Plenty of people claim income based JSA while living rent free at their parents' house, for instance.
Living with their parents is completely different than living with another unrelated person. You cannot be found living together (for benefit purposes) with a person who you cannot legally marry, or enter a civil partnership.0 -
There's nothing to find in the partner living together thing and neither is claiming means tested benefits so why would it matter if they were treated as living together anyway.Alarm bells would ring as they could possibly be treated as living together with the other person in the property. To not have to pay rent for their share goes some way to suggest that the other person is supporting them and that they should not be entitled to any means tested benefits.0 -
Income based JSA is affected by partners income so if they were classed as LTAHW and the other party works over 24 hours then there would be no JSA payment (irrespective of savings)publicsectorworker wrote: »There's nothing to find in the partner living together thing and neither is claiming means tested benefits so why would it matter if they were treated as living together anyway.0 -

I will repeat myself again..... It is not your, or their decision to make. The correct course of action when claiming benefits is to answer all the questions honestly and declare all correct circumstances whether they be joint accounts or someone else in the household.
To fail to do so is to make a false statement and is a criminal offence under the Social Security Administration Act 1992.0 -
I know, I was taking issue with your suggestion that just because someone else is supporting them by letting them live rent free they can't claim means tested benefits.Living with their parents is completely different than living with another unrelated person. You cannot be found living together (for benefit purposes) with a person who you cannot legally marry, or enter a civil partnership.
Of course it could be evidence that they are partners but it's certainly not proof.0 -
The claimant only claims JSA. No ct or hb. Said this several time. How can investigator extend beyond JSA overpayment if nothing else is claimed. There is no financial support given to claimant from other person or anyone else. No financial support given to claimant. They live on JSA that's it. No rent paid no mortgage to pay. There no rent because its owned.so they dont claim housing or council tax benefit?
im not being nosy.. it is a becessary question.
if it is the person that your friend lives with and has a hoint bank account with, then things are REALLY serious.
living woth someone/oaying no rent/joint finances .....l0 -

So a stranger lets them live rent free, they give up single occupancy for said stranger.

you are totally missing the point that people are trying to make.
the fact that no housing council tax benefit is claimed, whilst JSA is would be an indicator that the person is receiving help financially from another person ( ie not being charged rent)
this isnt something that people usually do.... pay rent for someone/allow them to libe in your home rent free, unless there is some kind of relationship.... and it is this relationship that will be of interest as well as the undeclared savings/joint bank account.
just because someone says something is true, rarely means that the DWP will just accept it at face value. they will investigate and come to their conclusion.
the onus is on your friend to prove them wrong.
you say they have proof, so it should be OK.
but from the information you have passed on, it looks like they may have a fight on their hands0 -
Support is not financial just help with things the claimant finds difficult to sort.amd of the OP stated that the friend was living with a parent/sibling and that they had a joint account and were supporting them, then no one would comment.
the fact that the OP chppses to say 'they are single but live with someone else' even after they have been asked numerous times, yould indicate that this person isnt living with a family member0 -
If they're not partners the other person would be able to get second adult rebate on CT and so only pay 75%northerntwo1 wrote: »So a stranger lets them live rent free, they give up single occupancy for said stranger.
