Some replies (apart from the rather dreary don't feed the trolls) have been very informative, regardless of the intent of the OP.
Why do you think my intent was to troll ? It was a genuine question to a genuine problem... damn you people in here are weird ! Dont you think this can happen to someone, and wouldnt the logical thing be to come in and ask the question I did... damn !0 -

Why did you accuse debbie42 of implying that you're a troll? The words "regardless of the intent of the OP" don't suggest this at all. If you are genuine, then by your own admission, you've been given the help you wanted (owing to the generosity of MSE members) so there's no need for you to make accusations, nasty remarks, or sweeping and unpleasant generalisations about MSE members. The members of this forum are not weird. We are a community of like minded people, who are dealing with life's ups and downs, as best we can and are trying to help to one another in the process.
Unfortunately, some MSE members have encounted trolls who have tried to take the pi$$ out of them in the past and as a result they keep an eye out and advise other members if they think that this may be happening again. It is just a safety warning device used in order to try to keep this forum clear of pests! If you don't appreciate this, then that can't be helped and as you've received the help you needed, then there's no need for you to post again on this subject, anyway. But if you are fake, then trolls are not welcome here, so I'd advise you to crawl off and pester other people instead!0 -
The bank made an error and they should pay for this. I think in this case they should forget about the money the guy already spent and get the remaining out quickly.
These sort of mistake happens everywhere. Here is my case. I had a balnace of £1100.00 on my Credit Card( never had this much in one month, just moved into a new house and it just went up). I was paying off this card in full using direct debit. I saw another card with good balance transfer, transferred this balance and cancelled the direct debit for the first card. Guess what happned ? As per statement
PAYMENT RECEIVED - THANK YOU 1100.00
DD PAYMENT - THANK YOU 1100.00
Current Balance -1100.00
3 months since this happened. Still struggling to bring it to a positive number and all these time I get negative statements.
Am I going to report this ? NOOO

The bank are using all sorts of terms "theft" and "fraud" however after seekign legal advice from CLS Direct they say its a civil matter not a legal matter... they say the bank making the error is the bigger problem...
They say they are using "theft" and "fraud" as a scare tactic and have advised us to talk to the British Bankers Association with a view to making a complaint about the tactics used by the bank...
They did say however we are definetly liable to pay the money back... its a little under £11,000 now some stuff has been returned0 -

No, it will be a error, and soon someone will realise and ask for the money back.
Banks do make mistakes sometimes, and also their other customers sometimes make mistakes and pay money into the wrong account. Legally you are not entitled to keep this money, because it doesn't belong to you. If you knowingly spend the money, then it is theft and you can be prosecuted. In reality, this doesn't happen because the banks don't want the bad publicity.
I note the OP's friend had debts of around £5000. I presume, on finding this windfall, he paid these debts off. I also presume that these debts were incurring interest on a daily basis. The OP's friend should therefore explain to the bank that he intends to re-pay the money on a monthly basis, using the money that would otherwise have gone to repaying his debts. As a gesture of goodwill, and an acknowledgment that they were partly to blame, the bank will probably accept re-payment on an interest free basis. So your friend will be better off, since now instead of paying debts back with interest, he has an interest free loan.
The bank may also allow your friend to keep the interest the £195000 earned while it was in his account, which will mean he benefits again. They may also offer a small amount of compensation if your friend has had to make any phone calls or spend time writing letters about this.
