Bank Error - £195,000

Ok this is indeed my first post, but that is why I have come here
So this is totally genuine...
A freind of myn had £195,000 paid into his account, this was a bank error obviously... however this friend is a pensioner and not well off, he had a weak moment and went and spent an amount of this money...
The bank have realised their error and are now threatening him with the police.
Now I understand he shouldnt of spent the money, but hey if it had been my account I would of been on my way to Vegas with £195k ! I bet there are a lot of people who would give in to temptation, no ?
I am sure I read of incidents like this happening before... anyone know any links to stories like this, and more so the out come of them ?
Anyone know what he should do ? Would be nice if people could be helpful here, and not just say how wrong he was

why assume he is a troll just because it is his first post?! Need more details i think. But surely the bank wouldn't be threatening with police - its their error. Yes it is theft, but then you and he knew that already. Obviously they will try to get it returned without taking it to court as it is both cheaper and less embarrasing in illuminating their mistake. However that said this will end up in court if not repaid and they will more than likely win, see R v Ngan 1998, not exactly the same but similar principle. As for sentence who knows, depends on whether it spurs your friend to repay the money.0

The simple fact is this is real... my friend told me as he is concerned, I googled a few keywords to try and find forums where I could pose this question... what was I suppose to do make a dozen posts before askign the question I needed answering... ?
Anyways here's the deal... there was £195,000 overpaid into an account that already had £1200 in it... my friend some payments, then realised there was more money in his account (he actually thought it was £19,500) which wasnt unrealistic as he was waiting on some money potentially from some sales he made (long story)
He went onto spend around £16,000 that figure isnt confirmed yet as bank tryign to stop/retrieve all they can... I think it will be somewhere between £6000 to £10,000... as I said in my opinion the bank are lucky it wasnt the whole £195,000... I have no scrupples would have withdrawn the lot and gone to Vegas... either returned a millionaire or broke... but hey thats me :rotfl:
My friend is a pensioner, he is hard up... I am not defending him just saying their were circumstances... I wonder how many people out there if they found £195,000 wouldnt do something with it...
The bank made a major !!!! up, both in putting the money in his account and putting the temptation his way... they surely have to take an element of resposibility...
The funny thing is he was chasign the bank claiming back his bank charges over the last year, including incured interest on it, I told him he should of said thats what he thought the money was :rotfl:

my thoughts exactly! he should just tell the bank that , and tell them the money will be back with them shortly!James thinks worrying is like a rocking chair, it gives you something to do, but it doesn't get you anywhere

As I said long story... he is a amateur photographer and was trying to sell content to the USA... the sale was actually £12,000... it isnt confirmed yet... so alas not definetly coming in... if it does of course he will use it to pay back what is owed (well at least some of it)
But apart from that he is hard up... he had £1200 in his account and a tonn of debts that more than covered that, infact covered it about 4 times over...
The fact remains that he is 62 years old, the bank made a major **** up and he gave in to temptation, if the bank doesnt make the mistake he isnt put in this situation... and now is under stress over it all
Anyone got any links to examples of where this as happened and reports of the outcome ?0
