Bank Error - £195,000

Mate you really need to get all the facts together here.
You said he was a pensioner yet is only 62. Expecting £20k from a sale but it's only £12k but not confirmed. He spent £16k but it might only be £10k!
The fact is he has taken money that isn't his. That is theft. If he doesn't pay it back he can be charged and imprisoned.
Like I said before. He needs to take everything he bought back and get full refunds.0 -
Troller is looking for a response...ANY response, and he will chum the waters with complaints, insults, compliments, and inflammatory tidbits hoping that someone...ANYONE, will take the bait. Generally quite harmless - practices a form of catch and release. Nonetheless, he can upset the delicate ecology of a discussion forum. Once a forum becomes aware of his presence, however, all feeding activity ceases and Troller must move on to more promising waters.0

He went onto spend around £16,000…
When looking at a banking mistake, there are two key questions. Was the recipient or should the recipient have been aware of the mistake? Would returning the money immediately cause financial hardship? These are detailed in Financial Ombudsman Service’s banking - mistaken credits.
Similarly, it’s not theft, if you genuinely don’t notice the mistake. The Theft (Amendment) Act 1996 states the following.24A. - (1) A person is guilty of an offence if-
(a) a wrongful credit has been made to an account kept by him or in respect of which he has any right or interest;
(b) he knows or believes that the credit is wrongful; and
(c) he dishonestly fails to take such steps as are reasonable in the circumstances to secure that the credit is cancelled.古池や蛙飛込む水の音0 -

So this is totally genuine...
A freind of myn had £195,000 paid into his account, this was a bank error obviously... however this friend is a pensioner and not well off, he had a weak moment and went and spent an amount of this money...
The bank have realised their error and are now threatening him with the police.
Now I understand he shouldnt of spent the money, but hey if it had been my account I would of been on my way to Vegas with £195k ! I bet there are a lot of people who would give in to temptation, no ?
I am sure I read of incidents like this happening before... anyone know any links to stories like this, and more so the out come of them ?
Anyone know what he should do ? Would be nice if people could be helpful here, and not just say how wrong he was
Brilliant post!. Pity it is a load of cr.p.0 -

Some replies (apart from the rather dreary don't feed the trolls) have been very informative, regardless of the intent of the OP.Debbie0
