  • Yes,the car park is around the corner from Maplins,its a single storey and isn't a pay and display.

    THANK YOU everybody for your'e valuable time particularly on Christmas Saturday,its re assuring to know that inspite of all the bad news that circulates around in this day and age that there is still some good will out there. Have a great Christmas-ile update after my visit...

    make sure you take pictures of the signage and where it is placed etc , then check if it conforms to the BPA CoP

    if its not a p&d car park then the landowner cannot have suffered a loss , so not a gpeol applies if it goes any further

    but if the shop can get it cancelled, that is the quickest resolution, otherwise with our help you win at popla if the ppc do not cancel it

    If the car park is attached to only one store, and it is that store who have contracted out their parking - then they are responsible for the actions of their contractors ( agents)
    You should at this stage be taking a good look around here.
    Take a read of this http://parking-prankster.blogspot.co.uk/2013/12/laying-groundwork-prior-to-reclaiming.html dont forget that whoever contracted the parking company are also liable for the actions of the parking company.

    In my opinion it is whoever contracted the parking company ( ie shop/store/landowner/pub/management company etc) that should be at the front of the Que regard complaints and any action that could/should be taken.

    When you go back to complain park at B&M as its not a P&D or at Tesco’s and walk round to B&M. Parking at Tesco is free for up to 3 hours as part of the planning consent for the store.

    I live locally and never use the peel centre as a matter of principal. Tesco win as well because we always end up buying something in there.

  • Thank you to all contributors who helped initially with my query.

    Here is an update on my actions to date and responses .I called into B and M's and complained to the Manager and albeit they acknowledged the situation and sympathised i got no where.I equally rang their customer services which likewise came to nothing.

    As the registered keeper I have not received anything in the post as yet from the parking company ,however they have responded to my email of appeal and as predicted they have rejected my comments and offered the usual options ie ' pay up ' the reduced amount by next Friday or appeal and face the outcome of potentially the full payment and costs.

    I have been back on site and assessed/photographed the signage to which i counted several signs,one on the left hand side of the entry,a 'one sided sign' were we parked with the warning notice was on the other side the rear being blank.The residue were scattered around the site and arguably out of our entry vision.

    As such i would be grateful on any advice about my next move,is it as simple as emailing and saying that i wish to appeal further and asking for the Popla code ! and then playing the waiting game. Ps the store car park is shared with Dreams beds

    So what you are saying then is that you've ignored the advice on waiting for the Notice to Keeper, there is a reason for that, now you've admitted to being the driver, this can have impact on this! When we give advice its for a reason!

    Now wait for the notice to keeper to arrive, they must send it to the registered keeper, and ignore the threat of increased costs, there is only one way this is going and that's zero - PROVIDING YOU FOLLOW ADVICE!
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Did they offer a POPLA code? If not just email back and say ' if this is your attempt at a rejection letter you have failed to comply with the BPA CoP. You must send me a rejection which includes a POPLA code and you cannot pretend I need to appeal further, when clearly I have already appealed. This was reminded by email from the BPA to all AOS members this month and if I do not get my POPLA code from you next week I will complain about JAS to Steve Clark of the BPA and David Dunford of the DVLA about your utter disregard for the POPLA procedures. You may like to note that this matter is being discussed on a well known forum and the POPLA appeal will include the fact that your charge is not a genuine pre-estimate of loss and will call for a copy of your unredacted landowner contract. You may prefer to bail out now as JAS have been shown to do recently when faced with such POPLA appeal points. '

    eventually he got a working and valid popla code and you can see his popla appeal in there, so yours will be similar or adapted from it

    then they cancelled once they saw his submitted popla appeal
  • Really grateful for the recent updates and advice,sorry i hadn't wished to !!!! things up so i consider myself chastised...So here we go i'm in your hands !

    The email i rec'd was very similar to dave b's with the identical 3 concluding paragraphs outlining their ' final ' options 1) pay by the reduced amount by 31/01/14 ,2) appeal, popla website details offered,3) waiver rights etc etc.There was also a 10 digit verification code which i'm now guessing from dave b's appeal is the popla code.

    As recommended i read the 4 pages of the recent similar case .Whilst i wait for the NTK am i correct in my interpretation of the advice that i should still check the verification code on the popla site for validity and resist replying to there rejection email to confirm that i am going to appeal through popla.

    Ps does the 29-56 day period for the serving of the NTK start from next Friday, ( end of my final appeal time ) or is from the date of initially receiving the ticket
