PCN @ B and M car park Stockport

Hi i was wondering wether anybody could help particularly as i appreciate it is so close to Christmas.

My wife called at the above premises with two of our children and made a purchase from the shop ( till receipt time 12.30 ).She then went back to the car placed the goods in the boot and went off the site to find a toilet and change our sons nappy as she couldn't see one on site -only 2 superstores there.At 12.48,time of the PCN ,only minutes before she returned there was a ticket which outlined the alleged contravention ie 1) unauthorised parking and 2)using the car park providers premises and went elsewhere at the time of the PCN.

The PCN has been issued by a co called JAS and outlines that we have 14 days to pay or 28 days to appeal,together with early payment options.

I have looked at other threads and appreciate this appears to be a well documented subject albeit that there seems to be various view points about the defence of an innocent mistake.

Its hardly surprising the central shopping centres are crying out for customers .Spend £45 and get a ticket for £56.40 early payment or £ 94,a bit ironic when you think my wife went to B and M's because its a discount store....If anybody could help in guiding us through the process or i would be really grateful.Particularly if there are any template/standard responses i ought to use as i wouldn't like to shoot myself in the foot-its expensive enough at this time of year.

    Okay in the spirit of Christmas I have good news for you, you don't have to pay this scam fake invoice from a private parking company . Now please answer a few questions

    1) who gave you this ticket?
    2) is this England or Wales?
    3) are you the registered keeper?
    4) have you contacted the parking company?
    5) have you made complaints to the retailer?

  • Thank you for your prompt response,hopefully can wipe the bead of sweat from my brow...!

    1)Im not sure who put the ticket on the windscreen,i guess they must have a warden who patrols around looking for innocent victims.I guess he was a member or representative of the parking company.Suprise surprise when my wife looked araound after she found the ticket there was nobody there to be seen...coward.
    2)The site is in stockport,england.
    3)My wife was the driver on the day and I (husband) am the registered keeper.
    4/5)No we haven't contacted the parking co with any form of communication,nor have we spoken to the B and M store.

    Okay thanks - here is what to do, nothing enjoy the Christmas period with your family and friends :)

    But make complaints to the retailer on this, tell them as a customer you expect them to cancel this fake parking ticket. In January or February if it hasn't been cancelled come back here when your notice to keeper arrives from these jokers.

    We will then help you get this appealed and cancelled, in the meantime educate yourself about this scam, below is a link to start doing this.

    If you go instore insist in speaking to the store manager themselves, if you get fobbed off complain to the head office. Is this a single store car park or a multiple one? You may have to find the landowner/agent otherwise and make complaints there. Google is your friend on this

    If you don't park at B&M but instead at the Peel Centre, for goodness sake buy a ticket. There are way too many threads on here from people who got caught at the Peel Centre :D

    Just relax over Christmas, things haven't really started until you get the NtK, but when that comes, we'll see you through everything. Just make sure you revive this thread and let us know when it comes.

    looks like its near Maplins looking on the map, opposite the infamous Peel Centre !!

    as mentioned earlier, make sure you keep that original receipt and complain to the store manager, insisting (not asking) that the ticket is cancelled due to patronage of their store

    I assume its not a P&D car park as you never mention it, so the landowner suffered no loss due to your vehicle being parked there and no trespass was happening due to using the facilities of the shop

    not a leg to stand on if it comes down to not a genuine pre-estimate of loss

    it will be another of these stupid rules where they think they can ban people for going "off site"

    they may not even have a contract allowing them to legally form the parking contract (its happened before with B+M like the tescos incident), also its down to planning permission too

    looking on JAS website they include Maplin in their portfolio, and are a member of the BPA too

    when the NTK arrives appeal it with the usual details, and demand a popla code if its not cancelled (if b+m dont cancel it)

    then with help from here it will be quashed at popla

    then its their loss not yours ( £27 + vat or thereabouts for a popla appeal)
