Another Draft Rejection - UKPC

    Had a reply from UKPC re my appeal after sending the basic letter drafted above by Stroma.

    Their reply had no POPLA code attached, and is a generic looking 'our charges are reasonable and your charge been on hold during this appeal and may now be settled at a reduced rate'

    Their letter was also not signed by anyone.

    So, what's next? Do i send them a letter telling them that their failure to provide a POPLA code is a breech of something, and stick their charge where the sun doesn't shine, or do i just ignore everything else that arrives?

    If you are certain there is no hidden POPLA code (10 numbers) and no POPLA form on the back of the letter, then send Gan's letter from pepipoo or a version like it, short and sweet:

    But check carefully what you have already in that letter. Two people in the last 5 minutes just nearly missed the fact they had a POPLA code or form in their rejection letter after all (Gawd knows how except we know some PPCs hide it):

    reply and reiterate the letter that stroma wrote, noting that under the BPA guidelines they are required to issue a POPLA code and that you should not have to ask for one the first time, never mind in a subsequent letter (they are stalling)

    also mention that if they fail to adhere to the BPA CoP again you will be putting in written complaints to the BPA and to the DVLA in the strongest possible terms

    I just re-read the letter to double check for a POPLA code, and the only number on the letter is the parking charge reference number, which actually has the last digit wrong!

    I haven't got the time or inclination to keep writing to these idiots, its not something i enjoy doing, and as Gan wrote in the thread at Pepipoo, "They don't deserve it but give them one more chance"

    As far as i can see, they had a chance to provide a POPLA code, they replied with a letter full of BS about them taking legal advice and that their charge is valid and that they have reduced the amount demanded, all in reference to the WRONG parking charge reference number, in a letter that isn't signed.

    I can't be bothered to give them another chance, so is there a draft letter online anywhere telling them that they failed in their reply and to cancel the charge and go away? Failing that, can i now just ignore any further letters from them, as what they have provided will probably have their case thrown out of court, should they decide to actually take it that far?

    despite feeling as you do, which I sympathise with, I feel its easier to take the bull by the horns now and get a popla code than any alternatives, I also would go so far as to say that ignoring this is actually stupid (being blunt here)

    you could complain to steve clarke at the BPA seeing as this PPC is not playing ball, the dvla too if you feel that way

    send him or them a copy of your reply as it breaks the BPA recent newsletter to all PPC`s so they deserve a good kicking

    but personally I would do as CM said and send the GAN letter , you can see from the link it scared them into cancelling the charge , which is the ultimate goal here

    dont lose sight of the ball just because of your fury at what has happened

    keep calm, and carry on , that is what you should be doing

    remember, at court a judge may ask why you did not follow procedures and insist on a popla code or complain to the BPA, its a reasonable question and you would have to answer it , court being the last resort here

    but hey, its your funeral, not mine

    good luck whatever you choose to do, but do not be rash at this time, because you still have time to sort this out on a reasonable if not level playing surface ;)

    So there's no POPLA form on the back either. Right, well if it were me I would send a letter saying get lost or send a POPLA code (easy to write!).

    Also shows you the sort of Debt Recovery dross you'll get if you don't act now. I would rather beat them at POPLA and cost them money, personally, than have to endure a year of junk mail and wonder if UKPC might start doing court one day.

    After all, Parking Eye were considered toothless this time last year, like UKPC, people ignored them - and they've now racked up some 8000 small claims cases against ignorers, mainly. I know what I would do and it would not be ignore!

    I'm not angry or anything, on the contrary, i couldn't give a damn! I'm not going to pay them, and if it goes to court i'll offer a pound or two a month. I'd rather that didn't happen, but i'm not going to be writing letters to all and sundry to fight this. I admire those who do, but i have bigger fish to fry at the moment!

    I'd rather not have the junk mail etc, hence asking if there was a simple 'you've messed up, get lost' type letter i could send to prevent that. - thanks Coupon Mad for that link.

    I don't wish to appear to be arguing with you all, or ungrateful for the advice by the way. I am very grateful for all the advice so far.

    I'll digest the info in the linked thread and draft a brief letter of reply in the next day or two.

    Oh, and definitely no POPLA code in the letter, only a false reference number. No forms on the back of the pages etc.

    I can scan them and post the image somewhere, or email them if anyone would like to see them.

    bear in mind they have 6 years to take it to court, that is 6 years of looking at the postman daily , 6 years of knowing what went on, keeping letters , all the DR letters and calls, nobody wants that , especially not for the sake of a complaint to the BPA or to demand your popla code and get popla to get them off your backs permanently , PLUS costing them money for being awkward ( £27 + vat or more)

    they are stalling, so your next steps are crucial
