Another Draft Rejection - UKPC

Hi folks,
Firstly, thanks to all those who have posted the useful information in these forums. I think i have taken enough onboard to appeal/reject a parking invoice i recently received from UKPC.
If someone could take a quick a look at my draft letter to verify it has no glaring mistakes, i would really appreciate it.
I have a scan of the ticket the driver gave me, which shows how the attendant number is illegible to human eyes. Not sure if it makes a difference to these things, but thought it was worth including in my letter. I can't post a link, but i can PM a link if anyone needs to see it.

Dear Sir/Madam,
With reference to a parking charge invoice received from you in the post, Ref No – 1234567891234, I wish to inform you of my outright denial of any debt owed to you, and to appeal this invoice.
The parking charge referenced appears to be for the driver of my vehicle leaving the site of a free car park. After conferring with the driver of my vehicle, they have informed me that they did indeed use this car park, to visit a business premises next to it. I have since visited this car park, and can find no specific’s as to what the site is, what area it covers, or what is on this site. As you are a third party in this matter, I fail to see how you can prove that the driver of my vehicle did leave the site, as you would not have a record of whether the driver used the facilities contained within whatever site boundaries you are referring to.
As this is a free car park, I fail to see what loss was incurred by yourselves, it certainly was not £100.
Also, I wish to bring to your attention the fact that upon viewing the ticket, I cannot make out the parking attendant’s employee number. The lines printed on the ticket appear to have all been printed 3 or 4 mm too low, and in the case of the parking attendant number, the printed text appears on top of the other text, and is therefore illegible.
In light of the above, please forward confirmation to me of you cancelling this ticket, and should you decline to do so, please forward me a valid POPLA code instead, so I can appeal to them directly.

Hands them perfect information to try a court claim under POFA.
Here is a simpler version:
The Registered Keeper denies liability for the parking charge as the registered have had no consideration received by the company claiming said contract
This is Legal notice of an Appeal.
Dont forget the POPLA code in your response.Be happy...;)0 -
It makes no difference. Unless you are not the registered keeper wait until the notice to keeper arrives before sending anything, it must be with you between days 29-56 after the parking event. One other thing, is this in England or Wales ?

It was in England, and i am replying to the NTK.
What information am i handing them, surely i need to supply some sort of mitigating circumstances to get them to cancel the invoice?

The chances of you writing anything in your appeal to persuade them to cancel this notice is somewhere between 'zero' and 'zilch'.
Your prime aim for this initial appeal is to acquire a POPLA code where the real job of appealing starts. And you won't need to be giving POPLA ANY sort of mitigating circumstances, because EVERY appeal we've seen to POPLA based on mitigating circumstances has been REJECTED.
Get your initial appeal off to the PPC and in the meantime read the NEWBIES sticky and the HOW TO WIN AT POPLA sticky to prepare yourself for the next stage.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Frankly, yes i would, as the whole 'driver left site' thing is a disgrace when there is no signage showing the boundaries of the site. If these charges were due to a real loss being made, the car parks wouldn't be free, so its pretty obvious that these charges are all a bit of a con, and these parking companies are just trying to make a quick buck.
Regardless, point taken, re-doing my letter now!

Dear UKPC
I am as the registered keeper of ( reg) and in receipt of your notice to keeper xxxxx dated xxxxxx, all liability to your company is denied, so as the RK I wish to invoke your appeals process on the following:
1) This charge is not a genuine pre-estimate of loss
2) You do not have the authority or permission to give these invoices to motorists
3) Your signage is inadequate, and does not comply with the BPA Code of Practice
You are therefore invited to cancel this charge now, or supply a popla verification code to appeal to them on rejection, where you will be asked for a detailed breakdown of the above. As you know all appeals on the points above are upheld.
Please confirm cancellation within 35 days of the above date
