hi, received PCN from Vinci in Cardiff. ticket was valid, but must have blown upside down on dashboard when daughter returned to car. advice very much welcomed please.

Was this a ticket on the car or through the post? Is she the registered keeper of the vehicle? Is she over 18 ?

Hi thanks. Daughter is a minor just retrieving her scarf, wind must have blown paper ticket over when she opened door. Is there any way to kill this stupid claim off as I will return overseas very soon, as I work there! So I won't have access to their stupid letters etc0

As advised I have read many threads etc, but as I will be overseas for an extended period imminently, is there any way to kill this unfair claim off now (as a valid ticket was purchased), just that it accidentally got turned over. Many thanks. From what I have read the parking services company will reject and then there is a procedure and claim to POPLA etc. I won't be able to adhere to letters etc. cheers0

There is only one way to kill this off immediately is to pay the scammers. This needs to be appealed once to the parking company and once to popla on rejection. If you appeal now you admit to being the driver and that lessons your standpoint. the only non-paying method of killing these charges stone dead and quickly is to get the LANDOWNER to cancel the ticket
the longer way is popla, if the ppc do not cancel it at the soft appeal stage0 -

Either complain to the landowner to get it cancelled (was it a Store, or a Train Operator maybe?) or get a relative to do the appeal procedure as driver, if they are in this Country. It really is easy and a 2 stage appeal, covered in links in the ''Newbies read this first'' thread.
The relative can appeal right now to the windscreen ticket, no reason why not just to get it done, and if need be they can write as you if you prefer (as long as they come here and take over this thread and see how to win at POPLA!). So they could do the appealing for you:

I am the driver {or using your name, 'I am the registered keeper'} and this is my appeal to the above PCN.
A ticket was paid for and displayed in good faith, and here is a photocopy of it (attached). Your signage does not create a contractual obligation to 'continuously display' and I have no idea why the ticket was not seen later on after the vehicle was parked with it displayed on the dashboard - it is not for me to guess what happened. The point is that there was no 'contravention' of your displayed rules and neither Vinci nor your landowner client has suffered any loss.
My appeal is based on the two main assertions that:
- your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner, and
- Vinci is not the landowner so as a mere agent you have no standing, title nor authority to form contracts with drivers nor to pursue this in the courts in your own name.
In every case where a motorist has raised these two issues, POPLA have accepted the appeal in 2013. You are therefore fully aware that there is no prospect of your charge being upheld and I invite you to cancel the charge now.
If you decide to continue to pursue this matter and reject this challenge then please supply a POPLA code. However please be aware that further points may be raised and when my appeal is upheld at POPLA. In addition, take formal note that I reserve the right to claim my expenses from you and my time in challenging this parking charge at the court rate of £18 per hour from now onwards, since you have been made aware at this earliest opportunity of my winning POPLA points. You have no cause to proceed further with this, and it would be a waste of my time and your money to continue. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me beyond this point, you agree to pay these costs when I prevail.
I look forward to receiving your confirmation that the ticket has indeed been cancelled and my data removed from your records, since you have no cause to store it.
