  • all the advice I have been given, is pay the rent and be grateful the LL lets you live there, as he might issue you with a CCJ that is up to him, as it seems even thought I am repeatlly asking him to do jobs, and he is refusing to even come out to the house to look at the problems, I am in the wrong, if he wants to sue me let him, I will wait till he has paid his legal bills then go bankrupt, am not bothered any more

    Nobody is saying be grateful that the landlord is letting you live there, personally I think he sounds like an awful person and would very much advise you to leave.

    However no matter how awful your situation is you cannot just break the law willy nilly. There are legal methods you can employ in this situation and done properly you can come out of this situation ahead of your landlord financially.

    If you choose to just walk away right now you give your landlord the ammunition to cause you financial problems further down the line (court order to pay the owed rent) which will mean you probably can't afford to then sue him for the deposit. If you pay your rent now and move out once you're legally allowed to then you can sue him for the deposit and get up to 3x the amount on top of it. That will really be a kick in the teeth for him.

    If your landlord has broken the law and doesn't care about your well being and you want to get even, the way to do it is to follow the law :)
  • possible mulder, but every one seems to think I am a troll, and this is all made up, I have had 10 months of crap living in this house, I was just going to run down my tenancy and move out, but after this last problem I have had enough of his excuses, he is due out tomoz and might shock me buy saying ok will fix it, but I don't think he will, if this was the first prob, then fair enough, but its been prob after prob and I have had enough now

    nope what people are advising you is to follow the right procedures, which will then enable you to legally withhold your rent, get the repairs done while removing the legal right of the LL to apply for a CCJ or get you evicted.

    Attitudes, such as don't care bout CCJs, bankruptcy, I'll just walk away I don't care are very Immature.

    You sound very young, trust me you dont to incur CCJs and/or bankruptcy.

    If you hate living in a shiithole, then incurring one of these is a good way of ensuring that you will spend the forseable future in similar types of properties.

    We're beginning to think you're immature or a troll because you've started three separate threads within 24 hours even though they're all about the same situation (just different elements of it). You then ignore every bit of good and legal advice you've been given, just want to do what you were already going to do and throw around childish statements. You say you've been told that environmental health can help you but you just winge about them ignoring you, but how long has it been since you first contacted them......a few days??? Act like an adult and follow up with them before implosively rushing off to do things that could adversely impact you.

    for too long I have let him walk all over me with the BS and excuses why he cant come out to even look at the house, yet still pay him is rent every month, of cause I will be breaking the law by not paying him is rent, for a house I deem unfit to live in,

    but why should I, I pay for a house to live in, with the leak it isnt fit to live in, so what am I paying for

    like I said I am not bothered about a ccj, if withholding the rent is the only way to get him to do the work, then it will have to happen
  • Ok so let me get this right, rather then doing it all legally and getting back £2400, you want to do it illegally, mess up your credit file, put your family in the crap because you have bad credit, just to save £800? hmmm sounds good to me, go for it. lol
  • I am happy to pay the rent, when he does the work, but its been 10 months and he still hasn't fixed jobs that where meant to be fixed when we moved in, any jobs that have been fixed are ones we have done

    I am happy to live in the house wants it is deed fit, but at the moment, I have running down the bedroom wall and bathroom wall, yet I should pay for this luxury, all my LL does is find a muppet who will rent his house for a year get £10k out of them and when they leave find some one else
  • You have to take the rough with the smooth when renting. If you can't handle that, buy your own property. Withholding rent will likely come back to bite you - either through credit files or landlord taking you to court.

    so say I pay the rent how long do I give him to do the work, as been waiting 10 months for some of it

    the final straw was when a bit of the ceiling came in, and I phoned him up and he said I will come around tonight, that was last month, am still waiting, I phone and text him, asking when he is coming and all I get is, I a, bisy at mo, will be there as soon as I can, I paid last months rent, but will with hold this months, till the work starts
