UK Parking Control - Ticket not compliant?

Hi,

I received this parking charge notice today whilst parked in a bay I was unaware was restricted. Here's the ticket I got (minus my details);

Looking at the Parking Cowboys website, among a list of requirements for the ticket, it states that the notice to keeper must "Invite the registered keeper to pay the outstanding parking charge or, if he was not the driver, to provide the name and address of the driver and to pass a copy of the notice on to that driver". I can't see this on the PCN, does this mean it isn't compliant? What action should I take?

    I got ticket from the same people but it does have it on my ticket

    The rules of the trade club for the scammers.
    Just appeal it on some daft reason and demand a popla code with the rejection letter.
    Use the magic bullet GPEOL for popla and cost em £27
    Be happy...;)

    So you're saying write to them now stating that (in a nutshell) £60 cannot be a genuine pre-estimate of loss, and that I'll require a POPLA code should they refuse this appeal?

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Okay nothing really there that stands out, so unless you are not the registered keeper, just wait for the Notice to Keeper to arrive within days 29-56 after parking, then do a soft appeal to get a popla code. Come back to us when this happens, so we can help you with both appeals.

    You are jumping the gun because that wording is needed on the first letter, the Notice to Keeper that we recommend you now wait for.

    The actual words of schedule 4 of POFA 2012 are linked in the sticky thread 'newbies, have you got a private parking ticket? read this now!' and your (driver's) windscreen ticket has to comply with paragraph 7. We don't recommend you appeal now, too early unless it's a company or hire car. Then the NTK, when you get it, must comply with paragraph 8 and you will be appealing as the registered keeper only, from a stronger position where you can cite POFA breaches.

    See the sticky thread mentioned, read the advice I have stuffed into the first post there, wait for the NTK and in the meantime complain to the landowner if you have grounds (i.e. if it was a retail park I would say definitely complain but a 'no permit' ticket suggests it's a residential block and you are likely to get any complaint ignored if so).

    Do ask questions while you wait for the NTK which cannot arrive until after day 29 and up until day 56 so it might be a nice New Year surprise letter!

    As Stroma says wait until you receive the notice to keeper to arrive - what you have there is a parking charge notice attached to the windscreen for the driver - I know I have one in my handbag too! It informs you that if payment is not made within 28 days, then they will apply to DVLA for registered keeper details.

    You state you were unaware of any parking terms - so go back and take photographic evidence which will support your POPLA appeal.

    UKPC signage is usually totally inadequate - hidden signs, often no entrance signage or non compliant entrance signs. Any signs which are present are usually tucked away in corners and with the actual sign about 8 foot high on the post - conditions written in small lettering.

  • Just noticed something on your ticket though which is not compliant -

    The address given is their OLD registered address and they changed to new address in September this year!

    New address is:

    The Apex
    2 Sheriffs Orchard
    Coventry
    CV1 3PP


    This is an offence under the Companies Act as any invoice for payment should contain the correct address. The OP could file a complaint at companies house.

    (Sadly my notice was dated prior to their registered office change)
