about a year ago, my partner lost control of his car on an icy road...
as he didn't want to go through the insurance company so as to avoid losing no claims bonus etc

But presumably they still told the insurance company about their accident. If not, it is going to get interesting.

Unless your a farmer its not for you to say what the costs are.
  • so what about the oil and coolant contamination to his soil in that area if the car spewed its load there?

fence post and fencing, fuel to go get it, labor time to erect it, labor time to correct the oil and coolant contamination to the soil in that area.

No harm in asking for a breakdown of the figures to back it up, at which point you can see what if anything is excessive.

That's the best advice in this thread. Write and ask for the full breakdown, then you can dispute it, using your professional knowledge as a backup.

No I get that you have to replenish the land but I was under the impression that most seeds could supply a single crop repeatedly? Not just once...

I take it you have no connection with agriculture or horticulture, don't live in the country, don't do any gardening, etc., etc.? Because you clearly haven't got the slightest clue about how to grow things. Either that or you are the Minister of Agriculture and I claim my £5!

Whether the costs were £200 or £2000 is a moot point. The farmer wants to go down the insurance route so arguing the toss about what the costs are is irrelevant. Give them your insurance details as requested and leave it at that. I'm assuming you haven't informed your insurer as you should have done?

As above, it's in the hands of the insurance company so saying now that you could have fixed it in half an hour with some planks from B&Q is a bit irrelevant. One of the local farmers now makes a point of "securing" vehicles that crash into his land until a cash bond or photo id and proof of insurance are provided. He's been done over too many times.

You have presumably informed your insurance company about the accident haven't you? And declared the accident, if you've had to renew your policy? If not, you could be in for a few uncomfortable conversations with your insurer.

I know exactly how much it would cost me to repair my car should I crash it. That bears no similarity to the cost of an insurance claim for the same amount of damage.

It's a tricky one this. Most crops are self-sufficient aren't they? So they just grow back every year. I'm pretty sure ploughing a car through them isn't going to do them any good though.

£1000 may be excessive, but I'd say £200 is very low, even if that is what the damage came to in your own mind. There's the inconvenience factor as well, don't forget that.

Self sufficient crops, Id love some of them on my farm:rotfl:, the reality is variable inputs can be anything upto £1000p/ac depending on the crop, damage could have been to potato bulks, a control traffic area (where traffic is reduced by the use of high accuracy GPS) the list could go on. dont forget crops can only be harvested once in 12 months so any damage is a total loss for the following year.

Restating a fence, and compensating for the loss for a grand sounds reasonable to me.

Although the other party's insurance company are asking for your insurance companies details you are not obligated to provide them if you plan to pay out your own pocket.

The problem occurs usually though within your own insurance policy and it's wording.
Most will say you need to report all accidents to them within X amount of time.
If you don't, and they find out they may be more concequences than you're currently facing.
