Argos Delivery van wrote off my parked car, there ignoring me. advice needed!

Hi forum, I am wondering if you can help me with a problem facing my sister in law.

Her car that was parked outside her house was hit by an Argos delivery lorry, months ago, and the situation is yet to be resolved.

Here is a statement of what happened to her.

‘Whilst delivering an item to my neighbour, the Argos delivery lorry reversed down the close, and as witnessed by my neighbour hit my stationary parked car.

Once the delivery was made, the lorry proceeded to vacate the close, in which I noticed what damage had been done to my car (I was looking out the window in my front room).

As the driver showed no attempt to seek to contact me or anyone else regards the damage he had done, I had to run up the close after the lorry in an attempt to catch the driver before he drove away leaving the scene of an accident (surely an illegal act?).

I managed to get the driver’s attention just before he vacated the close, in which he stopped his vehicle, and spoke to me.

The driver told me that he had thought he had hit my car, and he said that his intentions were to vacate the close first before seeking the owner of the car he had knowingly damaged.
I am unsure if he would have stopped had I not ran after him and made him stop.

I obtained the driver’s name.

After we had exchanged details (information and insurance details) I called Argos to notify them of the incident. I was told by a customer services representative that I would be called back by someone who would deal with the situation.

I waited but did not receive the promised reply. I called again to speak to someone who could help me get the details I required to help me make an insurance claim against Argos for the damage caused by one of their drivers/employees.

I contacted my insurers, A-Plan Insurance and notified them of the incident outlined above.
I hold Fully Comprehensive Cover.

Since my initial contact with Argos and my insurers (more than 10 weeks ago) I have had no contact from Argos, and my insurers have heard a minimal amount of information about the claim.

No one has contacted me on behalf of Argos regards the incident or how we are to proceed with a solution to this problem which has left me with no transport for the last 9 weeks as the car is damaged too much to drive safely with my 2 year old daughter in the car, due to the back window being unsecured and the dents leaving week spots in the car shell/bodywork.



The car’s MOT certificate has now expired and soon to run out of Road TAX leaving me with the dilemma of having a car which cannot be left on the road due to the damaged caused to it, and I cannot MOT it as it will surely fail due to it being not safe to drive due to the damaged caused by your driver.

I have contacted my insurers over the last few weeks, and they have informed me that they have received the bare minimum of information from Argos and their insurers. They have been told that Argos’ Insurers, Robin Staite Associates were looking into the matter.

They told my insurers that they cannot do anything until Argos supplies them with a report from the Argos vehicle depot.

Neither of them has contacted me or my insurers to proceed with the next steps to resolve the issue.

Despite my car being covered by Fully Comprehensive insurance, my insurers said they cannot issue me with a courtesy car as until Argos supply the insurers with a vehicle report, which leaves me without transport for me and my 2 year old daughter, and also leaving me unable to take my 16 year old daughter to school for her upcoming GSCE exams.

In the end my insurers suggested I claimed on my own insurance to speed things up, but would mean I would have to pay the £100 excess on my policy then claim it from Argos later.

I did this simply to regain some form of transport (a courtesy car for just 7 days and is now back with the insurers).

My insurers have now got back to me with an estimation of £400 for my car, which minus £100 excess leaves me to now find a car for £300.

Although my Astra was an older model, it had no defects and was looked after very well, with low milage too.

I must stress that this incident is no fault of my own, but have been left in limbo by Argos, a company who I have had great faith in and shopped with many a time (as with all our family).

There customer support is terrible, despite being listened to by a few sympathetic ears and being promised that the issue would be looked at I have ended up with broken promises of returned calls.’


SO what should she do?

Her insurers APLAN have said that she should take the money offered for the write off of her car, and if she isn’t happy with the valuation then they can pursue that issue with the insurance company at a later date.

She now has no car and a very small budget to find a decent enough replacement.

But what about all the problems Argos have caused and failed to rectify?

Could she use her insurance legal cover to make a claim for damages, stress etc that has been caused by them?

Does anyone have the contact details or address of Robin Staite Associates (insurers of Argos)?
