    It's not a big point for a court defence and you can't assume the grace period is 10 minutes can you?

    OK, still not a major point for a defence that would win it alone. So just rebut the DRP letter then - tell them to cease & desist but only write as the keeper - and look out for a real LBCCC from PE in the New Year. At least you'd have something to reply to if you get that (see the LBCCC thread).

    ok i will ,what i would like to know is how they are going to be able to justify loss to buisness if 1 min 34 seconds extra was taken , the truth is they cant it angers me how these people are allowed to get away with this . surely they should of asked for £1.20 or whatever it was to cover at least 1 hours parking ^^

  • Tower Road is a large car park anyway - in busy times could easily spend that long just driving around trying to find a space.

    Don't forget that the 11 minute 34 stay is also just what Parking Eye state you remained there according to their ANPR system which is not a live feed anyway read Guys dads thread regarding Core Popla Appeal points and coupons ANPR post on page two of that thread.

    And do write back as the keeper to DRP stating that the matter has been referred back to Parking Eye whom you are still awaiting a response from so any further communication from them will be reported to the OFT and the Financial Obudsman . -

    All debt recovery firms should now have an interim permission to operate by now from the FCA as all existing licences expire on 31st March 2014 and the Financial Control Authority take over licence requirements. Provided debt recovery agencies have interim permission they will have a couple more months to apply for full permission.

    yes i has work now but im gonna go through all this over the weekend i would prefer to send a complaint to the csa regarding DRP constant correspondence at once, they should of stopped after my reply to there first letter.
    I look at how to word it to the csa they say on there website to pick out the breach from there rule book. after a few lines of reading i go crossed eyed lol , i wish these people could talk in a manner than can be understood by joe average lots of long words is all i see :cool:.

    but i am learning slowly hehe

    anyways thanks gain ! i will post my findings asap

    :mad: they have sent yet another letter !! 4 letters now. I responded to the first letter denying there claims

    I can complain to the CSA now ?
    Im looking through the code of practice but cannot see which breach it is , does anyone know which one it is off hand please

    No we are not that familiar with that Code of Practice - and it's new (Oct 2013). But you don't have to cite the exact breach - they don't expect you to be an expert! Just complain to the CSA about this harassment and that you've already written denying the debt, and there is no case to pursue against the keeper and they need to return it to their client as 'disputed/denied'.

    I received another letter in response to my late appeal of course rejected by PE today , they have stated that they have already sent letter before action letter i must of missed that one , so i should proceed straight to the pre-court action thing . so now im getting correspondence from both of them now , PE have said i should pay the amount given when the LBCC was sent and DRP say i should pay 150 LOL i plan to pay none to any of them .
    I will however in my pre action letter offer to pay the first hour and £10 admin costs as a resolve out of court, they will of course reject the offer but at least i tried to offer something.
