My advice to you is:
Write to debt recovery plus stating:
I deny any liability for the debt as no contract was formed on the day as the driver merely drove in and out the car park unable to find a parking space.
As debt recovery plus and Parking Eye are AOS members of the BPA, the codes of practice apply. In this case no period of grace was given to the driver on the day. This matter will be reported to both the BPA and the DVLA for investigation.
I suggest therefore that you instruct your client immediately to cancel the parking charge and look forward to receiving this by return of post.
Should any further action continue in this matter then further complaints will be made to trading standards and the OFT and should Parking Eye issue any court papers, then this will be defended in full in court and a counterclaim for harassment will ensue."
Send the above letter off to DRP and a copy to PE then email complaints to the BPA and DVLA (I've added addresses to these on CM's Newbie post tonight)
Incidentally you should also write to complain to the landowner of the car park - you don't state in your post which one??
By the way Parking Eye issue hundreds of court claim papers every month but only a small proportion ever reach court once defence papers are submitted. DO NOT IGNORE ANY COURT PAPERS FROM NORTHAMPTON - COME BACK TO FORUM FOR ADVICE.

You should have appealed; you are too late to appeal. Doesn't mean you PAY though! Even if PE tried court it would only be £150- £200 if they won and no CCJ nor repercussions for you if you then paid. And they lose too when well defended (with 'legalese jargon' though...). You could certainly add to the masses of complaints to the Golf Club, which you will find threads about if you search the forum for the keyword 'Tower' or 'Newquay' since this car park has featured loads of times here.
Relax and read stuff that's already here several times. That's why I replied the way I did. The forum can work for you if you put an effort in and you haven't even had a Letter before Claim yet. i got the letter from DRP and dismissed and thought ill just quickly double check to see if im still doing the right thing then bamm found out that ignoring is not the thing to do
Ok deep breath so your saying if it did go to court i wouldn't get a CCJ and would only have ot pay the 200 pound IF it goes to court ofc

Who says it is too late to challenge ? Only PE. If you're a militant type and like popping your head above the parapet rather than ignoring and hoping it all goes away why not write to them
The BPA Code of Practice ( for what it's worth ) does not quote any maximum timeframes and there is nothing to prevent PE considering an appeal at any time. Indeed it is up to all parties to avoid escalation to court proceedings

I wish to challenge this PCN and in the eventuality you do not cancel it then refer the matter to POPLA in accordance with the BPA Code of Practice
List your points of challenge , not a gpeol , no capacity to offer contracts etc
If you refuse to consider, or ignore my challenge and take court action instead, I will refer the court to the principles of Halsey v Milton Keynes NHS Trust and P4 Ltd v United Integrated Solutions plc regarding the allocation of costs

The idea here is that if they refuse the industry standard ADR process they potentially limit their ability to claim costs through litigation so there is very little point them going down that route .0 -
Ok i did a appeal via there website , i will write a letter as well , however meantime i responded to the first letter i recieved from DRP they completely ignored that and sent a further 2 letters since and was given advice from a kind person off this site to complain.
what do i say ?
also i haven not heard from PE about the website appeal although it is probably too late to appeal even though i was at my mums for around months before returning home.
It turns out i was in the car park 11 mins 34 seconds i spoke to the owners and stated that he was sure it was 10 mins grace period ... surely this would not get anywhere in court is my thinking.
Either way i REFUSE to give these thief's anything !
