you have to wait for a reply from EE, they should refer you to CISAS a which point you put in your claim.
Has anyone received a reply from CISAS yet? They indicated a lead time of 5 days
Thanks! And I heed your instructions... Patiently waiting for EE/T-Mobile to contact me now...
Thanks for your help0 -
just received this...dont know if it helps but the second paragraph (between the **)was in a different font/colour as though it had been added to a standard letter....is this bit to show they are being reasonable and nice or is it of importance ??
presumably i just proceed to CISAS ? is it correct i do not need a deadlock reference?
THANKS TO RANDOMCURVE for all his help!
"Thank you for your letter, received in the Executive Office, I have been asked to respond on behalf of EE.
**I am sorry you are unhappy with the recent Price Increase. As a company we are committed to offering the best value for service which is why we have kept the increase to a minimum. The increase is a result of the rising costs to our business and is in line with the Retail Price Index (RPI), which is a measure of inflation.**
EE do not feel that this change is of material detriment to you as it is in line with the Retail Price Index (RPI), which is a measure of inflation. I acknowledge you do not agree with this decision therefore the next step would be to seek independent adjudication via CISAS.
You may refer your complaint to CISAS without a deadlock reference. CISAS will determine whether the complaint falls within the jurisdiction of its ADR Scheme. We may argue that it does not. If CISAS agrees its Scheme applies, it will adjudicate on the complaint in line with the Scheme rules. CISAS's details are as follows:-
CISAS
International Dispute Resolution Centre
70 Fleet Street,
London,
EC4Y 1EU"

Your move, EE/T-Mobile.
Excuse the mess, not at home with a computer so had to edit and upload and everything using phone!
This is a GOOD sign. It means that CISAS believe the dispute does fall within their remit - this is a major hurdle we have just crossed!!!!
When T-Mobile increased prices last year we had to get Ofcom involved to make CISAS accept that the cases DID fall within their remit. The trick is to ensure that CISAS understand that the claim is to with a breach of the T&Cs and NOT the" business decision" to increases prices - this is why I was at pains to stress this in the CISAS case.0 -
Phil - Yup, just go straight to CISAS, and leave the deadlock reference box empty. Best of luck!
Edit:
Glad you think this is a very good sign. Just gotta hope it doesn't drag on for an age, although it seems T-Mob/EE/Orange have 2 weeks to faff about before responding!
Perhaps the stuff that happened last year and the eventual outcomes meant that CISAS have realised that it'd do no good to dismiss it out of hand this year0 -
My CISAS claim just gone in. I'm a bit late to the due to holidays....
many thanks once again RC... Couldn't have done it without your help.0 -
I (with some others) have started a new campaign group to help consumers fight EE and O2 price increases and to try and get Ofcom to do the job that it is supposed to do (protect consumers). The website is in prototype at the moment, but everything is in place so that we can publish the template letters and CISAS case on the new website in word document format so that you can find the templates and edit them more easily. It should "Go live" on Monday and I will post a link to the site once it is up and running.
As a campaign group whilst access to all of the templates will be totally free - as it is here I will also have a standard "complaint" email which I will ask (no obligation, you'll still be able to access the templates) for you all to send to Ofcom and the press.
The next major piece of work will be writing the response to EEs Defence. If past history is anything to go by the defence will be complex, and the response to it will also be complex, but is vital if we are to succeed as the adjudicators take at face value anything EE put in their defence so unless you provide evidence that it is not correct you will lose.
For examples see the change in T&C defence and response:

Same here, received this afternoon0 -
Just had my CISAS letter back via email as well. Wonder how many EE will have to pay 300 to defend??? There isn't £300 worth of payments left on the minimum term of my contracts. As the previous poster says - EE, your move.0
