I sent a chase to OFCOM with RC's OFCOM complaint, they've ignored it for 4 weeks now!!! it won't help my EE case any but hopefully i'll be a big enough pain in EE's side they'll just cut their losses with me.
Thanks - the more that send it the more pressure Ofcom will come under.
According to Ofcom the Change in T&Cs which allows EE to use RPI rather than the lower of RPI and CPI, was change that made no difference to EE being allowed to use RPI - are they serious?????
This is why I urge you to contact Ofcom (copy in the media) to get this sorted.

Im not giving up, and posted an email to Mr Swantee regarding the t's&c's before I emailed EE about the price rise. So another CISAS case going in, referencing the adjudicators findings that I should've cancelled when I got the chance, also in my requests are an apology for them not advising me of my right to cancel due to the terms and conditions change, which will hopefully help you all out if I succeed in full.
I hope this will be accepted even though I have already been through the process as EE did not get back to me for my initial email in early april and it has only just ticked over the 8 weeks for me to contact CISAS. Maybe RC can help with any words of advice if his signal gets better along with himself. Until then I will forge on and hope I get some quotable proof to send to Ofcom and fight on.
If you contacted EE and said you wanted to cancel and they ignored you - then yes go for it - and reference the adjudicators finding too.0 -

Question: If an adjudicator in the past two weeks has rewarded someone on here Success with backdated cancellation and compensation, would it not stand that someone else with near same contract deal situation and of course near identical template of there reply to EE/TM/Orange defence that they should get near the same results from the same assigned adjudicator?
It's not rational that the Same adjudicator could go against his previous ruling could it?
Nothing is rational where Ofcom and CISAS are concerned!0 -

Post up another success RandomCurve! To my amazement I have succeeded with my claim about T&C's despite being over the due date to complain, according to EE. (used one of the templates for that one).....
CAn you remind me of the template used as I want to put a case together that those who are "out of time" on T&Cs can still go for it.0 -
Ill email the full response but the adjudicator states some interesting points and is consistant with the t+c case. They mention that the change in t+c does not warrant a right to leave the contract as there would have been no loss. She agrees however that as they changed the t+c then they should be bound by the ofcom gc9.6 guidance and they have failed in there duty of care. They also define material detriment as "being worse off"

They did ignore me so I have more ammo for this luckily. I don't know how much good my request for an apology stating that they should have offered the penalty free cancellation and didn't. Maybe it won't help anyone but if I get it fingers crossed everyone can use it to show ofcom etc.0
