Mobile Phone Contract - Price Rise Refunds

    Post up another success RandomCurve! To my amazement I have succeeded with my claim about T&C's despite being over the due date to complain, according to EE. (used one of the templates for that one) No compensation, only asked for £25 anyway but will have my PAC and be out of the contract at least. I think the shotgun approach used by EE in their submissions to CISAS is doing them no favours As soon as my EE home broadband expires I shall be getting away from that too. They must have lost so much loyalty over this issue.
    The best is during the last week EE have been phoning me and telling me that I'm entitled to some amazing discounts on Laptops and IPad's, the bloody cheek of it. I did get into the argument with one caller who actually told me that my mobile increase was going to be less than £1 a month so why worry. My reply of course was that if a £1 a month is nothing then why don't they cancel it? Silence followed just before I hung up.
    My adjudicator was Dr M by the way.

    Oooo! I got that too! They offered me contracts and lots of things... Thought it was a bit suspicious as I've been with them over 2 years and never got that before :\ as soon as I file a CISAS they're giving me free things LOL

    • The claim dated 7th May 2014 is for disputed: “contract terms”; for the company to “give a
    backdated penalty-free cancellation and a PAC and unlock code” and pay compensation of

    • The determination of the company is explained in its 28th May 2014 defence, to which, the
    customer has provided an undated response.
    • The customer submits that the company’s price increase amounts to a “material detriment” and
    he should be permitted to cancel his contract without charge.
    • The company’s position is that it denies liability.

    I have the same adjudicator and waiting on my decision.Looks like its all going pear shaped.
    the same adjudicator on T&Cs thread had rejected a case too. Just search on google with her name and moneysavingexpert....
    Looks like her decision is favoring EE as the reason given to you contradicts her decision for at least one applicant on the basis of T&C change....

    I just wonder who the CISAS working for? in the interests of consumers or in the interests of company?phew....

    Totally agree and unfortunately for you i dont think you stand a chance (i hope you win however!), same as i didnt. Its disgusting that the exact same cases are having different outcomes just because of a persons opinion. Theres clearly no consistency at CISAS which is the most annoying aspect. Theyre their to help the consumer and be fair yet now take EEs side and be quite condescending in the process...

    Ive already rejected the decision in anger tbh, hope it wasnt too soon for me to take them to the SCC. Even if i lose im considering paying my contract off to get away from the robbing so and so's

    Happy for you but even more infuriating for the people who have lost and complained in the time frame!

    Im not giving up, and posted an email to Mr Swantee regarding the t's&c's before I emailed EE about the price rise. So another CISAS case going in, referencing the adjudicators findings that I should've cancelled when I got the chance, also in my requests are an apology for them not advising me of my right to cancel due to the terms and conditions change, which will hopefully help you all out if I succeed in full.

    I hope this will be accepted even though I have already been through the process as EE did not get back to me for my initial email in early april and it has only just ticked over the 8 weeks for me to contact CISAS. Maybe RC can help with any words of advice if his signal gets better along with himself. Until then I will forge on and hope I get some quotable proof to send to Ofcom and fight on.
  • I have accepted the result I had back from CISAS. I have had their auto response. What is the protocol with EE now. Will they just cut off the phone over night in spite or will give correct notice so I can arrange a new contract with someone else.

    What will happen if EE does not comply with the ruling. ?

    Good luck, there is another forum which deals with the T&C's change, i remember thinking when i got the text i should have phoned up and said i wanted to cancel gutted i didn't now. fingers crossed it works out for you.

    I sent a chase to OFCOM with RC's OFCOM complaint, they've ignored it for 4 weeks now!!! it won't help my EE case any but hopefully i'll be a big enough pain in EE's side they'll just cut their losses with me.
