Jet2's application to appeal has been refused. :j:beer:0

Quote, presumably from Jet2 or their representatives -
"The European National Enforcement Bodies have agreed that unexpected technical defects, such as the one in this case, are outside of the control of airlines, and would therefore be considered extraordinary for the purposes of compensation. The ongoing European review of EC261/04 also recognises this."
What complete tosh, piffle and twaddle , shame on you.
Well to be fair to Jet2.com the NEBs clearly get to determine aviation law in the UK. Oh, er, hold on a minute. They don't. That'll be the high Courts of the land. WHO HAVE SPOKEN.0 -
Congratulations and well done to everyone involved. My letter is in the post tonight to Thomas Cook who has been dragging their feet with my claim since 2011 for nearly 8K and now plus interest.
The CAA should be given a vote of no confidence and disbanded with a new totally independent government funded association set up and not funded by the airlines. That man that keeps appearing on Watchdog saying they are here for the consumer and not the airlines should also resign.0 -
It's not over yet. They can still take it to the Supreme Court. That would be their final Hurrah though.0

Fantastic. Our claim (with Bott and Co also) was on hold pending this result. Large group claim of over 90 passengers.0

Do you really think they will succeed? On what basis. Judge Elias statements were simple, plain and IMHO comletely correct.
As we all knew 3 years ago......If you're new. read The FAQ and Vauban's Guide

I've been waiting for this result before sending nba. NBA going tomorrow and action to start in 2 weeks. Are Jet2 likely still to go to court to defend the claim based on 'technical flight shortcoming'?0

I thought they were refused appeal?

Refused appeal in that court yes but they can still take it to the Supreme Court and I'd be certain they will do.
I have no idea if they will succeed but they have nothing to lose apart from a very immaterial amount of cash.0
