Great result. Just heard statement from Jet2 on radio saying they are disppointed with result and will be seeking leave to appeal to supreme Court. There could still be a twist. They also apologised for delays! Practically what now happens with all cases on hold? Will the Courts write to the parties or should we be taking a proactive approach? Thoughts anyone? I would have gone for a proactive approach myself0

HUZAR WINS! JET2's PERMISSION TO APPEAL REFUSED!
Just like to add my congratulations to all involved!! Also, if there are any lawyers on line; in my case the airlines lawyer is suggesting that we set dates for a new pre-proof & proof hearing (am in Scotland). The case was sisted pending the outcome of Huzar and he has already raised the spectre of a further appeal by Jet! This sounds to me like having to go back to square one and buying time in the hope that Jet2 lodge another appeal. Already have a court date set for the 17th June and just wondered how I should handle this.
As always any advice much appreciated.

Links above do not work.
All stayed case can now go forward, the airlines will now have to apply again to the courts to stay the case. cases were only stayed pending the Huzar appeal case. I think they will give up myself as the wording of the regs, and the judges made very careful meaning of them before judgement.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

"The European National Enforcement Bodies have agreed that unexpected technical defects, such as the one in this case, are outside of the control of airlines, and would therefore be considered extraordinary for the purposes of compensation. The ongoing European review of EC261/04 also recognises this."
What complete tosh, piffle and twaddle , shame on you.If you're new. read The FAQ and Vauban's Guide
