Some thoughts here from emptysuit regarding the Dawson appeal (also heard this month). The comments would equally apply I would say.

Like Vauban I thought they were tempted to give their verdict there and then but probably thought better of it given the complexity of it. Court is on holiday next week but I would not be surprised if something came out in June as the submissions were a lot shorter than Dawsons.0 -
As a matter of interest, were the Judges hearing Huzar the same ones who heard Dawson?0

No they were not.0 -
I, like many others, hope Mr Huzar achieves the desired result with his claim.
I also think it's a very sorry state of affairs when airlines think they can ignore EU law (e.g. Wallentin) and force claims into the appeal court on issues which have in effect already been ruled upon in higher courts.
The result of the appeal is being reported that it will set a precedent which must make you wonder what use are the EUCJ rulings?0 -

Yes, but ... In fairness to the airlines, the Wallentin judgement was not especially well written and has plenty of holes. Indeed, the whole 261/04 regime has been a bit of a scrappy mess and allowed airlines to play silly !!!!!!s for a long time. What is really needed is some unambiguous precision, which we must hope the Court of Appeal will provide.0 -
