    The UK legal system seems to love to waste time as much as the airlines it would seem. Surly they realise that a lot rides on this judgement? And if it goes to appeal, how many more months will that take to get to the appeal courts? The whole process is a joke.

    Wow, for a company that is keen to get this overturned they are not playing by the rules are they? If i was the judge i would dismiss it.

  • Sorry my post was a bit ambiguous.

    Jet2/Bird & Bird have done their bit, it's now for the court staff to check the papers and then refer it to a judge - that's the bit we're waiting for.

    I think they are a bit streched at the moment what with almost everyone depending on this now for the time being.

    Coby presume the Judge can then say Foxtrot Oscar to Jet2/2Birds insofar as he doesn't agree to the Huzar case being appealed. What is the likelihood of this happening and if it did is there another/later route Jet2/2Birds can use to challenge?
  • I'm near enough 100% sure they'll get permission, because they just need to show a) the appeal would raise an important point of principle or b) there is some other compelling reason.

    Oddly enough, unlike a first appeal they don't even need to show that they have a real prospect of success.

    Given the impact of the decision I think they easily satisfy this test.

    If the court flips the bird to the birds then they can ask to have the application for permission to be heard in person (as opposed to on paper, which is what's happening at the moment).

    I think those of us advocating passenger rights and adherence to 261/04 should hope it will be appealed. If it is not, then Huzar remains ultimately a non-binding case. I welcome the prospect of finally nailing the point about technical failures and their relationship to "extraordinary circumstances".

    Thomas Cook are only asking for “stays” with all cases for three months with the courts. If the appeal is granted is it feasable to be completed within that timescale or will they just ask for an extension. Mine was supposed to be in court on the 14th January so the clock is ticking allready.
