If PE don't read this and cancel everything as suggested, it will be a major PR disaster for them and their new owners Capita plc.
Theres far too much effort being put in against parking eye, they are nothing but agents acting for and on behalf of the Range.
The Range or whoever it is that allows parking eye ( or any other ppc) to operate on their land should be the number one target in any action. From the Plain Language Commission:

Ohhh Yes I am going to do whatever CM suggests & tells me to do.
I just put that email from September 2012 up on here so everyone could see that I did appeal at the time & let them know of my illnesses. My thinking was that If any of the PE spys? Do read this forum, see the email, they would then be able to check their database & find the email themselves with the dates etc. Just thought it may help..?0 -
Hummm..as per the ranges facebook cs team, who told me to email the head office, I did so. I posted a link to this thread for them to read. This is their reply..I dont think they have read everything correctly though, as they seem to be thinking that its about a pcn, not a judgement ????
Dear Lorraine *********
Thank you for your email dated 26th!October 2013.
Unfortunately I am unable to comment on the policies and procedures used by ParkingEye as the company is not linked to The Range. I can however confirm that ParkingEye have been granted the relevant authority by the landholder CDS Superstores Int Ltd to provide enforceable car park management on site. On speaking to staff at Parking Eye I have been reassured that all guidelines are followed in accordance with the British Parking Association and that they are regularly audited by this body.
If you have any concerns regarding the Parking Charge Notice you have been issued I recommend that you discuss this directly with ParkingEye to prevent additional charges. I appreciate that the car park is used by The Range customers however the car park is privately owned and not the property of The Range.
Therefore if you wish to appeal against the notice you have been issued, please follow the steps documented on the Parking Charge notice and provide your proof of purchase where your case will be considered.
Please accept my apologies for any inconvenience this matter may have caused you.
Yours sincerely
The Range
Customer Service Team.

My word the Range are really attempting deceit here and attempting to wriggle out of responsibility.
The Range are a wholly owned subsidiary of CDS (Superstores International) Ltd sharing the same registered office:

OP I echo what others have said and follow CM's advice, but a strongly worded letter direct to the directors could follow suit claiming that a counterclaim for harassment is being considered.
Also OP have you considered contacting your local press and MP regarding this matter?0 -
You would lose all credibility - you cannot counterclaim for harassment. Only a judge can decide if it is, and this requires a Criminal action which an individual cannot initiate only the CPS/PF.
So avoid this cul-de-sac, and stick to facts that are quantifiable and can be pursued via MoneyClaim or the Small Claims track.0 -

Not so, there have been successful claims made against PPC's for harassment through the small claims court which have been detailed on the parking forum.
Also, an individual can file a claim for harassment without going through the criminal court system.

A disabled person can do, as harassment is a specific breach of the Equality Act if they 'knew or should have known' about the disability (PE and the Range both knew). As is 'failure to make reasonable adjustments'.
The remedy for breaches of the Equality Act is monetary damages.
The Range and Parking Eye are in the frame and I shall make sure all the clients at those car parks know as well.

Reply immediately and say:
'do not insult me with your standard fob-off about parking charges. TAKE NOTE AND REFER THIS TO YOUR HEAD OF CUSTOMER SERVICE, OR YOUR LEGAL DEPT. I am about to sue The Range for disability discrimination because I have suffered a CCJ because of the actions of your staff and your parking agent.
Do you understand? Look at this link again:

This is not something that a Customer Service Clerk can handle with a fob-off email template response. Pass the complaint to your Manager immediately, someone who can and will sort this out on Monday morning.
The Range will be receiving a court claim if not, and as you can see from the attached link I have the backing of people who will see this through.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You're on a roll this evening C-m. And with you now having a week off work, I'm looking forward to seeing more PPC-withering posts.
More power to your elbow, you're fantasticPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
