It would appear that this thread was reported to the MSE Forum team as the addresses I provided in post #27 have now been deleted -(perhaps suggesting that the director of The Range/CDS International has viewed this).

As I stated previously the addresses quoted are in the public domain via website www.companycheck.co.uk from which details of any limited company and directors can be found:

    http://companycheck.co.uk/director/903423593

This information is very much in the public domain when directors submit their own addresses to companies house and no way infringes any privacy rules any more than providing email contact addresses for complaints to be given.
  • OP - I would also consider at this point filing a complaint to Southampton trading standards department for The Range/Parking Eye breaching the Equality Act - and whilst your at it contact the taxation department to check if parking eye are paying their business rates.

I'm not sure I know how or who to contact & what to say in that instance?
I have received a snail mail letter from a Laura Theobald - parking management department @ Aldi.
4 days after I emailed them insisting that all communication be via email. It reads -

    PARKING CHARGE NOTICE - SOUTHAMPTON
    Dear Miss G********

Thank you for your recent email concerning the PCN you received. I hope you can appreciate the need to have a car parking management system in place, in a number of our stores across the uk, to ensure the provision of car parking availability to all our customers.

As you are aware, ParkingEye manages the Southampton car park using number plate recognition cameras that monitor cars entering and leaving the car park. This system is in place to ensure free customer parking.

As your letter does not provide the PCN details, I would be grateful if you would please contact me on (telephone number) to discuss the matter further.

Please be assured Aldi take all complaints very seriously and we are keen to address this matter urgently. Our car park management solutions are solely in place to ensure genuine customers benefit from our free car parking at all times.

I look forward to hearing from you.

    Yours sincerely.

Same kind of reply I had from the range isn't it.
Just as well I scanned in all the Aldi PCN's, LBA & receipt..
So I think I will email them at the email address I've been using for Aldi thus far & copy this letter in to it with my reply.
A reply simmilar to the one I sent The Range? - Discuss.

    Lorraine.

    Dear Miss G********

!Thank you for your recent correspondence, which has been forwarded to ParkingEye.

Having reviewed parking charge reference070855/802***, !we cannot find any evidence that ParkingEye’s actions could be considered!harassment, intimidation or discrimination.!ParkingEye would have happily dealt with any submissions made by yourself if you had appealed the Parking Charge or defended the claim. However, in the absence of a defence, default Judgment has been granted. As such, should you wish to continue defending this matter ParkingEye would suggest that you make an application to have Judgment set aside. You would need to contact the County Court in order to discuss this process further.

!Following discussions with our client Aldi regarding parking charge reference!150796/793***!we can confirm that this charge has been cancelled as a gesture of goodwill. Please note that this does not prejudice the above county court case.

!Please note that the data in relation to this enquiry is held and processed by ParkingEye and in order for enquiries such as this to be dealt with appropriately, please direct any correspondence to ParkingEye at!https://www.parkingeye.co.uk/Appeal!or ParkingEye Limited, 40 Eaton Avenue, Buckshaw Village, Chorley, PR7 7NA.

    Kind Regards

I am in touch with zzzLazyDaisy about this right now...

I knew they would cancel the Aldi one. One down, two to go. :)

I will pm you with the LBCCC that hopefully Daisy helps with shortly if she sees this or my email.

(OP are you sure this came from Paul Pindar as it is signed by ParkingEye Team?)

Incredible though - they certainly are in dire need of education regarding the Equality Act and what constitutes discrimination etc!

I also note that they are recommending that you apply to get the judgment set aside which may not be the best advice read this:
    http://www.trustonline.org.uk/understand-judgments-fines/set-aside-a-judgment/

It is cheaper for you to go down the route of applying yourself to the small claims court and with CM's and Daisy's assistance they will provide a very robust letter to send to all parties concerned (I would suggest joint and several claims to Parking Eye, Capita, The Range and CDS). Have you thought about writing a personal letter to Mr C Dawson (http://companycheck.co.uk/director/903423593 as if written appropriately, he may intervene as it was his staff at the range who said they would cancel the charge and his company owns the car park.

However what concerns me most that any action you take will be after the required payment date to comply with stopping the default CCJ made against you appearing on your file.

IMO If this is not resolved in time i.e. before you can commence your counterclaim then you should pay this amount. WRITE THAT YOU ARE "PAYING UNDER DURESS" (on the cheque) and make it clear in covering letter that you are paying this sum only to prevent a CCJ being lodged against you as this was a default judgment and that you were not given the opportunity to defend as the principal had misled you that they were going to cancel the charge themselves. State that the payment does not acknowledge any liability for the charge and does not preclude you for taking any further legal action in this matter against all parties involved. Make sure that you copy both letter and cheque together as evidence.

Did you have any joy with either Trading standards or your MP?

    :)

I am not so sure. Lainieee has a couple of weeks yet at least, and can send an urgent LBC giving them seven days to wipe the claim.

  • If I recall correctly, it is a month from the judgement letter that I must pay by..which that was 17th oct..so that would make it 17 nov...but.it also says to give 4 days to reach them. So if my math is correct.. that's 8 days.

I would have to pay by card, unless I went in to the bank snd asked them to draw a cheque...

Regarding Paul Pindar (the coward) he didnt deal with it personally it would seem..instead he fowarded it to the paking eye nodding dogs! Who in turn have emailed me with their drivel which I copied in to my post earlier.

I cant believe yet again they are disregarding my right to have longer parking before the PCN kicks in!!! ***holes... please excuse my french..atm im pretty annoyed :(
