Not really. You were making a blanket statement that the police would not enforce a law with no reference to the severity of the infringement.

Others are saying that a the police very sensibly allow (but are not obliged to) a little leeway with a law that we know they enforce.

As someone said, "apples and lemons". Comparing a threshold with a blanket refusal to enforce is very poor logic.

    It's apples and oranges.

their is a lot of rules/legislation that are left to the officers on the ground to use their own judgement to what action to take.

just like below are scenarios that can happen, but are left to the officer to what option they give

    1) you drive on motorway lets say 75 MPH and have full control of vehicle. You may get picked up by handheld speed camera at being over the speed limit and get pulled over and just get a warning

    2) you drive on motorway lets say 75 MPH and have full control of vehicle. You may get picked up by handheld speed camera at being over the speed limit and get pulled over and get a fixed penalty fine and 3 points

    3) you drive on motorway lets say 75 MPH and have full control of vehicle. You may get picked up by handheld speed camera at being over the speed limit and get pulled over and get a fixed penalty fine and an order to attend a driver awareness course

    4) you drive on motorway lets say 75 MPH and weaving in and out of traffic in a dangerous manor. You may get picked up by handheld speed camera at being over the speed limit and get pulled over and get a fixed penalty fine and an order to attend a driver awareness course

    5) you drive on motorway lets say 75 MPH and weaving in and out of traffic in a dangerous manor. You may get picked up by handheld speed camera at being over the speed limit and get pulled over and get arrested for dangerous driving

So you accept the 10% rule isn't valid as 75 MPH is below that threshold?

Quite right! You compare apples and oranges and it's the ANSWER that's a lemon. :o

i just used 75MPH as an example. it would also apply to 71,72,73,74,76,77,78,79,80,81,82,83,84MPH.

it all depends on various elements and the situation and i would also say the mood of the officer on the ground on what action the officer takes.

So we agree the 10% rule is not legally binding which is all I am saying.

I've agreed with you it's an informal rule up to the officers judgement. All I've been saying is this is not legislated for.

Which you now seem to agree with!

its a discretion given to traffic officers, but i don't think its 10% as i know for 30MPH they have a discretion of 3MPH, as your speedometer may be calibrated different to their patrol car or speed camera.
i know of this discretion as i was stopped in my van for what they told me their camera said i was doing 32.4 MPH in a 30MPH zone. I have a camera fitted in my van cab, which is used as a security feature, but this runs all the time. i showed them what the camera showed and i was just under 30MPH, they let me go due to their discretion of 3MPH as they normally would go off their camera and as i was in a van with a trailer they would have issued me with a FPN

I'm off out now but you do realise 3 is 10% of 30?

Anyway I've enjoyed the debate earthstorm and I think we are not that far off in agreeing so I'm sure we will interact again :)

yes, but i think this changes depending on the speed, so not a fixed percentage.

There's a few areas around me that simply have no room to park a car on the road. If they did, anything larger than a regular family car (ambulance or fire engine for example) wouldn't be able to get past.

Nearest place to park the car besides the pavement in these areas would be approx 10-15 minute walk in a high crime area, outside someone elses house.
    Not good for insurance premiums.

I don't do it with mines as kerbs, low profile tyres and stiff suspension don't go well.

The local police and council park on the pavements constantly though in these areas...

The ACPO guidelines for when a fixed penalty ticket should be issued instead of just giving out a verbal warning are fixed at 10% + 2mph.
So at 30, you should be okay provided that you are caught doing less than 35mph and in a 70 limit, you shoud be okay below 79mph.
