    just curious to see what you all think...

    We have better things to do than considering hypothetical conundrums for the fun of it - such as helping real people to deal with real problems.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • here's a question then, and one to ponder,

    If the car has to display a permit, the property is rented, then who is responsible for renewing the permit?

    if they can only take you to court for breach of contract, who breached it? the owner, driver, or person assigned to the flat, in which case, what happens if there is 2 names on the lease??

    surely this opens up loads of other avenues haha.

    No point in inventing scenarios... there will be no court.....

    I've also spoken to the management company and they basically said take it up with the boa but tell them if they're in breach.

    As far as they're concerned the car should have a permit on, and they have no idea on the rules and regulations of time limits.

    Doesn't matter if the Management Co have no idea about such things. The PPC is their agent and they are responsible, and liable for the agent's actions.

    Anyway we have found that the BPA respond within a week or so and often get these cancelled without fuss.

    Why are you emailing the BPA ? what do you anticipate they are going to do ??
    Why are you even worried ????

    Looking at your letter, Roxburghe / Graham White have a series of template letters stating "You have admitted to being the driver" and "You have offered to pay etc"

    Trust me, the Courts do not like "Grossly inaccurate assertions"

    Now let me get this straight....if by some chance Rox find new solicitors are you really asking me to believe that there will be a court case where solicitors act on behalf of rox, who are debt collecting for care parking, who are a division of a company who do not own the land

    I also live at SGI and are being chased by Roxburge for parking in the space i pay for. I totally think this is a money making scam and will not be paying. I am ignoring Roxburge letters at the moment and i will go to court if i have to. This company is out to make money out of residents not fine people for unauthorised parking. I have spoken to a number of people who live in the flats who have been fined for the exact same reason yet i have never known any actual unauthorised parking i.e. people who don't live in the building. You need a fob to get in so anyone who is in there is supposed to be. From the research I have done Roxburge are not allowed to access information from the DVLA they have been fined and 'struck off' recently for not adhering to rules. Therefore, i believe Care Parking is a new company set up as an extension of Roxburge to continue to gain information from the DVLA and then forward this on to Roxburge who then chase with threatening letters. It is all dodgy! The management company are not interested and are equally as dodgy when you look into the ownership - several companies all linked who all deny any responsibility for the contractual agreement with Care Parking.

    I tried to rally a few people round from the flats as i think everyone refused to pay we might get somewhere but people are too scared and pay up.....

    For now I will be ignoring all correspondence!

    Start your own thread please, there are a number of points you need to straighten out and pitching-up on someone else's thread is not the place.
  • Received this today. Surely they didn't write to me In time so are in breach. The bpa are saying they did?

    We have investigated your complaint with the operator and can advise you of our findings. There are currently 2 parking charge notices outstanding under your vehicle. As the parking charge notices were not paid, Anchor Security requested the keeper details from the DVLA. These were requested within the correct timeframe and unfortunately the DVLA took a considerable amount of time to return the details to them. This explains why you received the Notice to Keeper late.

    The operator is aware that it is not possible to rely on the provisions contained with the Protection of Freedoms Act, however they can still pursue the debt under the reasonable assumption that you were the driver or you know who the driver was. This would be up for the court to make a judgement on.

    Roxburghe did make an error when sending out a letter to you as they assumed you were the driver. They have agreed to amend their processes to ensure this confusion does not occur in the future.

    Roxburghe have confirmed the accounts are still outstanding and will be placed on hold for a further 14 days to enable you to confirm the driver details or to make a payment at the current rate.

    In view of the above, there has not been a breach of our Code of Practice and therefore consider the case closed.

    Dear Mr Dunford,
    Official Complaint about releasing my data late, to a PPC with no reasonable cause

    Please advise me if it is true that the DVLA are responsible for the inordinate delay in the case of two private parking tickets in this instance? That is the excuse the BPA Ltd are giving me for non-compliance by Care Parking:

    1. My car had a ticket on 23/3 my notice to keeper was dated 4/6 thus 73 days and should only be 56. When was the data requested and by whom?

    2. my car had a ticket on 9/4 NTK on 27/6 79 days. When was the data requested and by whom?

    See attached email from the BPA where they blame the DVLA. Please explain what occurred and when, for each occasion.

    This is my car and I do not expect to pay for this information from you because I certainly have a valid complaint against the DVLA or the BPA as well as the parking company, who are called 'Anchor Security - T/A Care Parking' - an oxymoron if ever there was one - and who use the notorious Roxburghe to chase their pretend parking tickets. Please advise me by return because I am being sent threatening debt collector letters by a PPC/debt collector. I suspected that they may have been too slow to bother to obtain my data which I think is a breach of the BPA Code of Practice but the BPA Ltd seem convinced this firm applied in time and blame you.

    This was in the period March to June 2013 when the BPA CoP version 2 applied and despite the fatally late Notices to the keeper (me) the PPC and Roxburghe have tried to suggest that registered keeper liability applies. Clearly it doesn't but the BPA Ltd have turned a blind eye to the whole complaint so I need some information from the DVLA and have copied in Mr Clark so he is aware of this ongoing complaint.
